a. Maximum of 30 individual residential units to be constructed in apartment/multi-family <br /> style buildings; <br /> b. Maximum building height will be 2 stories or not more than 30 feet from finished grade on <br /> the property; <br /> c. Minimum number of parking spaces will be 30; and <br /> d. Community center will not exceed 5,000 square feet and may serve both the on-site <br /> residents and individuals from the greater community,as needed, subject to Section 5, <br /> below(See Attachment B). <br /> *SFH will be subject to a PUD application and all necessary public review and approvals at the <br /> time SFH is prepared to proceed with their application. <br /> 5. Any expansion of the SFH community center to serve persons not living on-site would be considered <br /> separate from this Framework and shall not be funded from City Affordable Housing funding <br /> sources. <br /> 6. SFH Performance.SFH shall submit an application to the City of Pleasanton on or before June 1, <br /> 2020. If no application is submitted for the affordable housing site by June 1, 2020,then the City <br /> may entertain or solicit interest from other affordable housing developers. <br /> 7. Change of Developer.The key elements of this agreement shall be translated into conditions of <br /> approval and/or a separate agreements to ensure that any limitations and/or obligations are tied to <br /> the entitlements. <br /> 8. City Contribution The City's contribution to SFH shall not exceed$2.25 million, inclusive of the <br /> Affordable Housing Contribution from Developer in Section 3, above. <br /> 9. Other Approvals and Agreements. The parties acknowledge that the Developer's residential project, <br /> and SFH's future project, may be subject to specific provisions of a Development Agreement, <br /> Affordable Housing Agreement,Growth Management Agreement, Exclusive Negotiating Rights <br /> Agreement,General Plan and Downtown Specific Plan amendments, Planned Unit Development <br /> (PUD) re-zoning conditions of approval and mitigation measures,vesting tentative map(VTM) <br /> conditions of approval, and other related permits (including, but not limited to, building permits and <br /> encroachment permits),as well as referendum and other legal challenges. In the event of any <br /> conflict between the terms of such specific agreements,entitlements, conditions of approval, <br /> permits or challenges and this Framework,the specific agreements, entitlements,conditions of <br /> approval, permits and challenges shall control. <br /> 10 Other Provisions. This Framework may be executed in one or more counterparts,each of which is <br /> deemed an original and all of which taken together constitute one instrument. This Framework shall <br /> be governed by and construed in accordance with the laws of the State of California. <br />
