City will highlight tennis activities at the Park on the front cover of <br /> three(3)Activities Guides and either the inside or outside back cover of four(4)Activities <br /> Guides during the term of this Extension. City has the discretion to determine which issues <br /> of the Activities Guide will feature such tennis activities at the Park, and may consult with <br /> Lifetime." <br /> G. Section 4.0 Lifetime Tennis's Service Obligations, Section 4.13 Maintenance Services, <br /> Subsection b) is amended to provide that: "In addition to Lifetime's obligation to maintain <br /> and replace tennis court nets and windscreens at the Park, Lifetime shall also be obligated <br /> to maintain and replace tennis court nets and windscreens at PMS tennis courts. Lifetime <br /> shall coordinate with City, and City shall coordinate with Pleasanton Unified School <br /> District staff, for access to PMS by Lifetime and its contractors for such work." <br /> H. Section 4.0 Lifetime Tennis's Service Obligations, Section 4.13 Maintenance Services, <br /> Subsection d) is amended to provide that"Lifetime shall be responsible for all court light <br /> bulb repairs, except that when light bulbs are changed to LED bulbs on existing courts, or <br /> for the two new courts that will be built with LED bulbs,then the City shall be responsible <br /> for replacement of LED bulbs. Lifetime shall provide City with notice when LED bulbs at <br /> the courts are not functioning." City will endeavor to convert Courts 1 through 10 to LED <br /> style lighting by December 31, 2018. Should that not occur by that date, City agrees to be <br /> responsible for all bulb replacement after December 31, 2018. <br /> I. Section 7.0 Compensation is amended to provide the following payment from Lifetime to <br /> the City: <br /> 1) Jan. 1, 2017 to Dec. 31, 2017: Eighty Thousand Dollars ($80,000) <br /> 2) Jan. 1,2018 to Dec.31,2018: One Hundred and Five Thousand Dollars($105,000) <br /> i. However, if two new lighted tennis courts have not been built and put into <br /> operation at the Park by February 28, 2018, the City and Lifetime agree to <br /> renegotiate the amount of compensation for 2018; which amount may be <br /> administratively approved by the City Manager. <br /> 3) Jan. 1,2019 to Dec. 31,2019: One Hundred and Ten Thousand Dollars($110,000) <br /> 4) Jan. 1, 2020 to Dec. 31, 2020: One Hundred and Fifteen Thousand Dollars <br /> ($115,000) <br /> 5) Jan. 1, 2021 to Dec. 31, 2021: One Hundred and Twenty Thousand Dollars <br /> ($1 20,000) <br /> 6) Jan. 1, 2022 to Dec. 31, 2022: One Hundred Twenty-Five Thousand Dollars <br /> ($125,000) <br /> Page 3 <br />
