1. There are critical errors and omissions in the City's Jan. 28, 2015 <br />Staff Report, including the omission of the proof that that the <br />Masons are violating the City's codes. <br />a. The Jan. 28, 2015 Planning Commission Staff Report regarding the Masonic Center has <br />critical errors and omissions. As you will see in Attachment #1, when these errors and <br />omissions are corrected, the conclusions drawn from the document are substantially <br />changed. <br />See Attachment #1 for details of the errors and omissions. <br />Also, see item "d" below for a quick overview of the City's errors and omissions for the <br />zoning codes only. <br />b. Although staff's January 28, 2015 report does refer to the: <br />• 1977 conditional use permit (CUP), <br />• 1977 staff report, <br />• 1977 design review documents, <br />staff either omits critical information or creates incorrect conclusions. <br />See Attachments #1 & #2 for details of the errors and omissions. <br />c. Furthermore, staff's January 28, 2015 report contains none of the violations in the <br />current: <br />• General Plan, <br />• RM -2,500 zoning codes, <br />• Public notice. <br />See Attachments #1 & #3 for details of these errors and omissions. <br />d. For your convenience, below is a quick summary of only the zoning code errors and <br />omissions in the January 28, 2015 staff report. Please see Attachment #1 for a complete <br />summary of all errors and omissions. <br />1. Staff states, "The 1977 conditions of approval indicate an effective buffer be <br />provided between the lodge and the surrounding residential neighborhood." <br />Staff OMMITS A CRITICAL FACT that the land between the Millers and the <br />Masons is to function as the buffer (per email from Planner Donna Decker) to <br />protect the neighbors from the noise nuisance created by the Masons. <br />Therefore, when the Masons hold parties in the buffer, they are violating their <br />CUP. (Seen in Attachment 01.) <br />ii. Staff states that the 1977 Planning Commission "did not prohibit such openings <br />[doors /windows]" in the Masons' building on the side facing the neighbors. That <br />is, staff is saying that the Masons had the right to install the glass French doors. <br />THIS IS INCORRECT. The 1977 Design Review Board clearly states, "There would <br />be no windows in the other three elevations and the only other opening <br />2 <br />
