33. All activities at the Masonic Lodge shall conform with Chapter 9.04 of the Pleasanton <br />Municipal Code (Noise Regulations). <br />34. No music shall be allowed outside the building. <br />35. Live or pre- recorded music is allowed inside the building with doors closed. <br />36. An automatic timer with a motion sensor for safety shall be installed to regulate the <br />hours of the exterior light(s). Exterior light(s) on the north side of the building shall be <br />tumed off no later than 10 p.m. either manually or with an automatic timer. <br />37. The exterior doors of the facility shall remain closed when not being used for <br />ingress /egress purposes. The Masonic Lodge shall install and maintain self - closing <br />mechanisms on all exterior doors within 30 days from the date this approval becomes <br />effective. <br />38. If the operation and activities at the Pleasanton Masonic Lodge site result in conflicts <br />pertaining to parking. interior or exterior noise, traffic /circulation, public disturbances, or <br />violations of these conditions. at the discretion of the Director of Community <br />Development, this conditional use permit may be submitted to the Planning Commission <br />to consider modifications to the conditions or revocation. <br />39. Changes to the exterior of the building shall not be made without prior approval from the <br />Planning Division. <br />40. The applicant shall maintain the site in a clean and orderly manner at all times. No more <br />than three accessory structures, for storage purposes only, are allowed on the site. <br />Additional storage structures require City approval prior to placement/installation. <br />41. To the extent permitted by law, the protect applicant shall defend (with counsel <br />reasonably acceptable to the City), indemnify and hold harmless the City, its City <br />Council. its officers, boards, commissions, employees and agents from and against any <br />claim (including claims for attorneys fees), action, or proceeding brought by a third party <br />against the indemnified parties and the applicant to attack, set aside, or void the <br />approval of the project or any permit authorized hereby for the project. including (without <br />limitation) reimbursing the City its attorneys fees and costs incurred in defense of the <br />litigation. The City may. in its sole discretion. elect to defend any such action with <br />attorneys of its choice. <br />42. Any tenant improvement plans shall be submitted to the Building and Safety Division for <br />review and approval prior to operation. The applicant shall obtain a building permit prior <br />to commencement of any work. The applicant shall pay any and all fees to which the <br />proposed application may be subiect to prior to issuance of building permits. The type <br />and amount of the fees shall be those in effect at the time the building permit is issued. <br />43. Pleasanton Masonic Lodge shall comply with the Chapter 9.24 of the Pleasanton <br />Municipal Code (Smoking in Public and Work Places). <br />fend( <br />UP -77 -13 Modifications Planning Commission <br />Page 5 of 5 <br />
