ATTACHMENT # 1 <br />CONTRACT <br />MISCELLANEOUS LANDSCAPE SERVICES <br />THIS CONTRACT is made and entered into this 1st day of October, 2016 by and between Terra Landscape, <br />( "Contractor "), whose address is 463 Roland Way, Oakland CA 94621, and telephone number is 510 562 -4000 and <br />the CITY OF PLEASANTON, a municipal corporation ( "City "). <br />Recitals <br />WHEREAS, the City put out a Call for Bids for Street Medians, Main Street Color Bowls, Fire Stations <br />Landscape, and Main Street Sidewalk, Curb, and Gutter Maintenance services throughout the City; and <br />WHEREAS, after receipt and review of bids, the City has awarded to the Contractor a contract for Street <br />Medians, Main Street Color Bowls, and Fires Stations Landscape Services. <br />NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: <br />1. Work to be performed. The work will generally consist of maintenance of landscaping, including trees, <br />shrubs, groundcovers, vines, hardscapes, turf, and irrigation systems as delineated on the set of drawings <br />entitled Map of Sites, Miscellaneous Landscape Services, (Appendix III) and related activities as described <br />in this specification. <br />Said work is more particularly shown in the following documents which are on file with the Operation <br />Services Department of the City and are incorporated herein by this reference: <br />A. Plans and specifications entitled the Miscellaneous Landscape Services and addenda <br />thereto, if any. <br />B. Contract Amendments approved by the City, done in accordance with Standard <br />Specifications. <br />C. The Proposal submitted to the City by the Contractor. <br />D. Request for Proposals <br />E. General Provisions and Special Provisions. <br />2. Hours of Work. Contractor shall limit hours of work to Monday through Friday and 8:00 a.m. to 4:00 p.m. <br />The Parks Superintendent shall have the authority to change the hours and days of work to meet the needs <br />of the City upon notice to Contractor. <br />3. Compensation. The City shall pay the Contractor for work actually performed at the unit prices set out in <br />the Contractor's proposal to the City. The quantities of work stated therein are estimates only; actual <br />quantities will be measured for payment in accordance with the specifications. The annual contract amount <br />shall not exceed $490,000. <br />4. Term and Contract Renewal Option. The initial term of this Contract shall be from the date first listed above <br />until August, 2017. Thereafter, City and Contractor shall retain the right to renew the Contract for an <br />additional one year period up to, but not exceeding, four additional years. This Contract may be renewed <br />only by mutual written agreement between the parties. Each party retains the right to not renew the agreement <br />at the time of its annual review. If the parties agree to such a renewal, the terms shall continue and each of <br />the Contractor's unit prices set out in Contractor's proposal shall be increased based on the percentage change <br />in the Consumer Price Index for All Urban Consumer / All Items / San Francisco — Oakland -San Jose with <br />
