Section 4. Section 2-11-26 (Action by Zoning Administrator) of <br /> Article 26, Chapter 2, Title II, is hereby amended in its entirety <br /> as follows: <br /> <br /> "~2-11.26 Action by Zoning Administrator. <br /> a. If authorized by the Board of Adjustment, the <br /> Zoning Administrator may grant, grant in modified <br /> form, condition or deny a request for a variance. <br /> The Zoning Administrator must make a decision on <br /> a request on or before the tenth day following <br /> receipt of the completed application. The Zoning <br /> Administrator shall mail a notice of the action <br /> taken to the applicant, the Board, adjacent pro- <br /> perty owners or any others found by the Adminis- <br /> trator to be interested parties, on or before the <br /> fifth day following the decision. The Administra- <br /> tor's decision shall become effective at 5:00 P.M. <br /> on the fifteenth day following the decision unless <br /> an appeal to the Board of Adjustment has been filet <br /> with the Planning Department prior to that time. <br /> <br /> b. Applications not decided by the Zoning Administra- <br /> tor shall be decided by the Board of Adjustment. <br /> Upon receipt of the completed application, the <br /> Zoning Administrator shall schedule a hearing at <br /> the earliest possible meeting of the Board, taking <br /> into account time necessary for staff preparation <br /> and public notice." <br /> <br /> ction 5. Subsection 1 of ~2-11.29 (Action of the Board of <br />Adjustment or Zoning Administrator), Article 26, Chapter 2, Title <br />II, of the Ordinance Code of the City of Pleasanton is hereby <br />amended in its entirety to read as follows: <br /> <br /> "~2-11.29 Findings. <br /> 1. The Board of Adjustment or the Zoning Administrator <br /> may grant a variance to a regulation prescribed by <br /> this chapter with respect to fences, walls, hedges, <br /> screening, or landscaping; site area, width, frontage <br /> or depth; front, rear, or side yards; basic floor <br /> area; height of structures; distances between <br /> structures; courts; usable open space; o~ other <br /> regulations of this chapter but a variance shall not <br /> be granted for a parcel of property for a use or <br /> activity not expressly authorized by the zone regu- <br /> lation governing the parcel of property. Variances <br /> ~'rom these regulations may be granted only when the <br /> Board of Adjustment or the Zoning Administrator finds <br /> that the following circumstances apply: <br /> <br /> a. That because of special circumstances applicable <br /> to the property, including size, shape, topography, <br /> location or surroundings, the strict application <br /> of the provisions of this chapter deprives such <br /> property of privileges enjoyed by other properties <br /> in the vicinity and under identical zoning class- <br /> ification. <br /> <br /> -2- <br /> <br /> <br />
