CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 791 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 26 (VARIANCES), CHAPTER 2 (ZONING), TITLE II (ZONING AND DEVELOPMENT) RELATING TO THE AUTHORIZED PURPOSES FOR GRANTING VARI- ANCES FROM THE ZONING CODE, THE DATA TO BE FURNISHED AS PART OF THE APPLICATION FOR A VARIANCE AND THE FINDINGS TO BE MADE BY THE BOARD OF ADJUSTMENT OR A ZONING ADMINISTRATOR IN GRANTING A VARIANCE. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: Section 1. Subsection (a) of Section 2-11.23 (Purposes and Author- ity), Article 26 (Variances), Chapter 2 (Zoning), Title II (Zoning and Development) of the Ordinance Code of the City of Pleasanton is hereby amended in its entirety to read as follows: "§2-11.23 Purposes and Authorization. a. In order to prevent a particular property from being deprived of privileges enjoyed by other properties in the vicinity and under the identi- cal zoning classification due to special circum- stances applicable to the property, the Board of Adjustment is empowered to grant variances." Section 2. Section 2-11.24 (Board of Adjustment: Membership and Meetings) of Article 26, Chapter 2, Title II, is hereby amended to read as follows: "92-11.24 Board of Adjustment: Membership and Meetings. The Board of Adjustment shall be composed of at least three members of the City Planning Commission appointed by the chairman of the Commission. If the Board does not include the full Commission, its members shall be appointed for one year terms and shall serve until their successors are appointed. If the Board does not include the full Commis- sion, the Board shall elect a chairman who shall serve a one year term. The Board shall hold at least one regular meeting each month, provided that a meeting need not be held if no matters have been submitted for consideration of the Board." Section 3. Subsection l(d) (Data and Maps to be Furnished) of 92-11.25 (Application and Fee), Article 26, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton is hereby amended in its entirety to read as follows: "d. Precise statement of the variance requested, the special circumstances giving rise to the request for the variance and other data pertinent to the prerequisite findings set forth in 62-11.29."
