ORDINANCE NO. 2147 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE APPLICATION OF THE FRANK BERLOGAR TRUST FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-116 WHEREAS, Frank Berlogar of the Frank Berlogar Trust has applied for Planned Unit Development (PUD) development plan approval to construct two new detached single-family homes on new separate lots and retain a reminder lot containing the existing residence and second unit on an approximately 34.3-acre site located 88 Silver Oaks Court in the Vineyard Avenue Corridor Specific Plan Area; and WHEREAS, zoning for the property is PUD-HR/OS (Planned Unit Development— Hillside Residential/Open Space) District; and WHEREAS, the City Council determined that there were no changes to the environmental circumstances and impacts from the time that it certified the Environmental Impact Report for the Vineyard Avenue Corridor Specific Plan Area in March 1999 that require additional environmental review for this project; and WHEREAS, at its meeting of June 7, 2016, the City Council received a report from the Director of Community Development, including the Planning Commission's recommendations for approval of PUD-116; and WHEREAS, the City Council held a public hearing on June 7, 2016, at which time the applicant and other members of the public were offered an opportunity to present information regarding this application; and WHEREAS, after a review of the materials presented, the City Council determined that the PUD plan is consistent with the General Plan, the Vineyard Avenue Corridor Specific Plan and the purposes of the PUD ordinance based on the findings set forth in the report presented to the City Council on June 7, 2016, and information presented at the public hearing. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the project is exempt from further environmental analysis pursuant to Government Code Section 65457 and Title 14 Cal. Code of Regulations Section 15153 because it is consistent with the Vineyard Avenue Corridor Specific Plan and the Pleasanton General Plan, and creates no new impacts which were not studied in the previously certified Vineyard Avenue Corridor Specific Plan EIR.
