ORDINANCE NO. 2147 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF THE FRANK BERLOGAR TRUST FOR <br /> PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-116 <br /> WHEREAS, Frank Berlogar of the Frank Berlogar Trust has applied for Planned <br /> Unit Development (PUD) development plan approval to construct two new detached <br /> single-family homes on new separate lots and retain a reminder lot containing the existing <br /> residence and second unit on an approximately 34.3-acre site located 88 Silver Oaks <br /> Court in the Vineyard Avenue Corridor Specific Plan Area; and <br /> WHEREAS, zoning for the property is PUD-HR/OS (Planned Unit Development— <br /> Hillside Residential/Open Space) District; and <br /> WHEREAS, the City Council determined that there were no changes to the <br /> environmental circumstances and impacts from the time that it certified the Environmental <br /> Impact Report for the Vineyard Avenue Corridor Specific Plan Area in March 1999 that <br /> require additional environmental review for this project; and <br /> WHEREAS, at its meeting of June 7, 2016, the City Council received a report from <br /> the Director of Community Development, including the Planning Commission's <br /> recommendations for approval of PUD-116; and <br /> WHEREAS, the City Council held a public hearing on June 7, 2016, at which time <br /> the applicant and other members of the public were offered an opportunity to present <br /> information regarding this application; and <br /> WHEREAS, after a review of the materials presented, the City Council determined <br /> that the PUD plan is consistent with the General Plan, the Vineyard Avenue Corridor <br /> Specific Plan and the purposes of the PUD ordinance based on the findings set forth in <br /> the report presented to the City Council on June 7, 2016, and information presented at <br /> the public hearing. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the project is exempt from further <br /> environmental analysis pursuant to Government Code Section 65457 and Title 14 Cal. <br /> Code of Regulations Section 15153 because it is consistent with the Vineyard Avenue <br /> Corridor Specific Plan and the Pleasanton General Plan, and creates no new impacts <br /> which were not studied in the previously certified Vineyard Avenue Corridor Specific Plan <br /> EIR. <br />
