ATTACHMENT 5 <br /> URGENCY ORDINANCE NO. <br /> AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON AMENDING MUNICIPAL CODE CHAPTER 9.30 RETITLED "WATER <br /> MANAGEMENT PLAN" TO COINCIDE WITH THE ADOPTION OF THE URBAN <br /> WATER MANAGEMENT PLAN <br /> WHEREAS, the State of California has been in a record drought that required the City <br /> to activate the provisions of Municipal Code Chapter 9.30, retitled "Water Management Plan" <br /> to address water conservation; and <br /> WHEREAS, the City has also been updating its Urban Water Management Plan as <br /> required by State law; and <br /> WHEREAS, the City proposes to amend Ch. 9.30 to define a low water user, amend the <br /> process to suspend excess use penalties, and modify water use restrictions immediately to <br /> protect the public health, safety and welfare to prevent even greater water shortages during a <br /> drought, as well as coordinate with the adoption of the Urban Water Management Plan. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. The City Council adopts amendments to Pleasanton Municipal Code <br /> Chapter 9.30, retitled "Water Management Plan", as set forth the attached Exhibit A. <br /> Section 2. A summary of this urgency ordinance shall be published once after its <br /> adoption in "The Valley Times", a newspaper of general circulation published in the City of <br /> Pleasanton, and the complete ordinance shall be posted in the City Clerk's office after its <br /> adoption. <br /> Section 3. This ordinance shall take effect immediately pursuant to California <br /> Government Code §36937(b). <br /> The foregoing urgency ordinance was adopted at a regular meeting of the City Council <br /> of the City of Pleasanton on June 7, 2016, by the following vote. <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br /> Jerry Thorne, Mayor <br /> 1 <br />
