ATTACHMENT 1 <br />ORDINANCE NO. xxx <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF GUY HOUSTON OF VALLEY CAPITAL <br />REALTY FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER <br />CASE PUD -115 <br />WHEREAS, Guy Houston of Valley Capital Realty, has applied for Planned Unit <br />Development (PUD) development plan approval to retain the existing residence and <br />second unit and construct two new detached single - family homes on new separate lots <br />on an approximately 2.93 -acre site located 11249 Dublin Canyon Road; and <br />WHEREAS, an Initial Study /Negative Declaration was prepared for the <br />previously approved, but now expired, development plan (PUD -44) for this same site in <br />2006. The proposed development is substantially consistent with the previously <br />approved PUD -44, which was analyzed in the Initial Study /Negative Declaration. No <br />new information or changed circumstances have been identified, per California <br />Environmental Quality Act (CEQA) Guidelines Section 15162 that would require <br />supplemental environmental review; and <br />WHEREAS, at its meeting of April 19, 2016, the City Council received a report <br />from the Director of Community Development, including the Planning Commission's <br />recommendations for approval of PUD -115; and <br />WHEREAS, the City Council held a public hearing on April 19, 2016, at which <br />time the applicant and other members of the public were offered an opportunity to <br />present information regarding this application; and <br />WHEREAS, after a review of the materials presented, the City Council <br />determines that the PUD plan is consistent with the General Plan and the purposes of <br />the PUD ordinance based on the findings set forth in the report presented to the City <br />Council on April 19, 2016, and information presented at the public hearing. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. The City Council finds that the project is consistent with the <br />Pleasanton General Plan and the PUD District ordinance, and that the project is <br />consistent with the negative declaration previously prepared for an earlier rezoning of <br />this site. <br />Section 2. The City Council approves Case PUD -115 the application of Guy <br />Houston of Valley Capital Realty for a Planned Unit Development (PUD) development <br />plan (Case PUD -115) to retain the existing residence and second unit and construct two <br />new detached single - family homes on new separate lots on an approximately 2.93 -acre <br />
