BACKGROUND <br />On May 20, 2014, the City Council approved PUD -98, an application by CarMax to <br />construct an automobile dealership consisting of an approximately 11,783 square foot <br />sales building, an approximately 45,000 square foot service building, and related site <br />improvements that included a private road, Auto Mall Way. The private road will provide <br />access to the public right of way on Stoneridge Drive for CarMax and that are located on <br />the northwest corner of the Stoneridge Drive and El Charro Road intersection (part of the <br />Auto Mall site at Staples Ranch). Carmax was conditioned to construct the private access <br />road to serve their property and the Chrysler properties. <br />On July 24, 2014, the Staff Review Board, acting within its authority, approved a minor <br />subdivision map application by CarMax to subdivide an approximately 35.8 -acre site into <br />two parcels. <br />Improvement plans and the Parcel Map were prepared in compliance with the approved <br />PUD -98 and Vesting Tentative Map and were approved by the City Engineer. <br />On August 26, 2014, the City Engineer, acting within his authority, approved the Parcel <br />Map. <br />On September 9, 2014, the Parcel Map was filed for recordation at the County of Alameda <br />Clerk- Recorder's Office. <br />In the fall of 2014 Chrysler indicated that they needed the construction of Auto Mall Way <br />completed concurrently with the Chrysler dealership which was ahead of Carmax's <br />schedule. Mr. Zaheri entered into an agreement with CarMax and Alameda County <br />Surplus Property Authority to construct Auto Mall Way instead of waiting for Carmax to <br />construct the road. <br />The City and Mr. Zaheri entered into an improvement agreement to construct Auto Mall <br />Way on March 19, 2015. <br />DISCUSSION <br />Improvements Constructed <br />The improvement agreement provided for the construction of a public sanitary sewer <br />main, private water laterals, and private sanitary sewer laterals to serve the three Chrysler <br />lots. Private storm drain, private fire water line and related private improvements were <br />also constructed to serve the Carmax property. <br />The public improvements, as described above, will be maintained and operated by the <br />City. The private improvements, as described above, will be maintained and operated by <br />the private property owners. <br />Construction of the required improvements for Auto Mall Way has been completed. Staff <br />inspected the improvements for compliance with the approved plans and conditions of <br />approval and recommends that the work be accepted as complete. <br />Page 2 of 3 <br />
