BACKGROUND <br />On September 3, 2013, the City Council approved PUD -97, an application by Ponderosa <br />Homes to remove 32 mobile home spaces and related accessory structures, construct 12 <br />detached single - family homes, and retain an existing home on the north side of the site <br />for commercial use. The approximately 1.9 -acre property is located on the south side of <br />Stanley Boulevard and east of Main Street. <br />On November 13, 2013, the Planning Commission approved an application by Ponderosa <br />Homes for a vesting tentative map for Tract 8159 to subdivide the property into 12 <br />detached single - family home lots. <br />Improvement plans and the Final Map were prepared in compliance with the approved <br />PUD -97 and Vesting Tentative Map and were approved by the City Engineer. The City <br />and Ponderosa Homes entered into a subdivision agreement to construct subdivision <br />improvements to serve the proposed 12 lots. <br />On June 3, 2014, the City Council approved the Final Map, improvement plans, <br />subdivision agreement, and a reimbursement agreement for Tract 8159. <br />On July 2, 2014, the Final Map was filed for recordation at the County of Alameda Clerk - <br />Recorder's Office. <br />DISCUSSION <br />Improvements Constructed <br />The development constructed a public water main with service laterals and a public <br />sanitary sewer main to serve the 12 lots of the subdivision. Additionally, the developer <br />constructed a public storm drain on Stanley Boulevard to benefit this development and <br />the future project across the street known as DiDonato (now Kontech), a 13 -lot <br />subdivision (Tract 7968). Ponderosa Homes will be eligible for reimbursement of the pro - <br />rata share with development of Tract 7968 per the reimbursement agreement approved <br />by the City Council on July 2, 2014. <br />The development also constructed the following private improvements: a street (Gyles <br />Place, which connects to Stanley Boulevard as shown on Attachment 1), common area <br />landscaping, storm water bio- swales for treating storm water, street lights, and various <br />utilities necessary to serve the subdivision. <br />The public improvements, as described above, will be maintained and operated by the <br />City. The private improvements, as described above, will be maintained and operated as <br />provided for in the Declaration of Covenants, Conditions, and Restrictions for Ivy Lane <br />(CC &Rs). The CC &Rs were recorded following the recordation of the Final Map. <br />Construction of the required improvements for Tract 8159 has been completed. Staff <br />inspected the improvements for compliance with the approved plans and conditions of <br />approval and recommends that the work is accepted as complete. The developer has <br />posted the required warranty bond in the amount of 10% of the cost of the improvements <br />to cover a one -year warranty period in which defects must be corrected by the developer. <br />Page 2 of 3 <br />
