ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF H. JAMES KNUPPE FOR PLANNED <br /> UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT PLAN <br /> APPROVAL, AS FILED UNDER CASE PUD-109 <br /> WHEREAS, H. James Knuppe has applied for Planned Unit Development (PUD) <br /> Rezoning of the approximately 0.39-acre property located at 273 Spring Street from the <br /> C-C (Central Commercial), Downtown Revitalization, Core Area Overlay District to a <br /> PUD-C-C, Downtown Revitalization, Core Area Overlay District, and for PUD <br /> Development Plan approval to construct an approximately 4,074 square-foot, two-story <br /> commercial/office building with an attached, approximately 1,225 square-foot second- <br /> floor apartment unit, and four approximately 2,015 square-foot, three-story multi-family <br /> residential units, which new construction requires the demolition of the existing 910 <br /> square foot single story commercial building (the "Project"); and <br /> WHEREAS, at its public hearing on December 9, 2015, the Planning <br /> Commission adopted Resolution No. PC-2015-43, determining that the proposed <br /> Rezoning and Development Plan are appropriate for the site, making findings, and <br /> recommending to the City Council that PUD-109 be approved; and <br /> WHEREAS, on January 19, 2016, the City Council held a duly noticed public <br /> hearing on the application and considered all public testimony, agenda report, and <br /> related materials, and the recommendations of City staff and the Planning Commission; <br /> and <br /> WHEREAS, the City Council finds that the proposed PUD Rezoning and <br /> Development Plan are consistent with the City's General Plan and purposes of the PUD <br /> Ordinance as set forth in the agenda report, the demolition of the existing building is <br /> appropriate, and the Project is categorically exempt from further review under the <br /> California Environmental Quality Act per Guidelines §15332 In-Fill Development Project. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves the Rezoning of the approximately 0.39-acre property <br /> located at 273 Spring Street from the C-C (Central Commercial), Downtown <br /> Revitalization, Core Area Overlay District to a PUD-C-C, Downtown Revitalization, Core <br /> Area Overlay District. <br /> SECTION 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on <br /> file with the City Clerk, designating and dividing the City into zoning districts, is hereby <br /> amended by Zoning Unit Map No. 497, attached hereto as Exhibit B, dated January 19, <br /> 2016, and incorporated herein by this reference. <br />
