FO. "Person with an identification card" shall have the meaning given that term by <br /> California Health and Safety Code Section 11362.7, as amended. <br /> GO. "Primary caregiver" shall have the meaning given that term by California Health <br /> and Safety Code Section 11362.7, as amended. <br /> HE. "Qualified patient" shall have the meaning given that term by California Health and <br /> Safety Code Section 11362.7, as amended. <br /> 6.18.020 Operation of medical marijuana dispensaries prohibited. <br /> In addition to the other prohibitions in this Chapter 6.18, nNo person shall operate or <br /> permit to be operated a medical marijuana dispensary in or upon any premises in the <br /> city. <br /> 6.18.025 Commercial medical marijuana activities prohibited. <br /> In addition to the other prohibitions in this Chapter 6.18, commercial medical marijuana <br /> activities of all types shall not be operated or permitted in or upon any premises in the <br /> city. <br /> 6.18.030 Commercial medical marijuana cultivation prohibited. <br /> A. In addition to the other prohibitions in this Chapter 6.18, commercial cultivation of <br /> medical marijuana shall not be operated or permitted in or upon any premises in the <br /> city. <br /> B. The indoor cultivation of: (a) up to three (3) medical marijuana plants by a qualified <br /> patient; or (b) up to nine (9) medical marijuana plants by a primary caregiver—three (3) <br /> such plants each for a maximum of three (3) qualifiedpatients being cared for by that <br /> primary caregiver; is not prohibited as long as such plants are not visible to the public <br /> from a public area and such plants do not utilize space otherwise needed to park a <br /> vehicle in a garage. <br /> 6.18.035 Operation of commercial medical marijuana delivery prohibited. <br /> In addition to the other prohibitions in this Chapter 6.18, all commercial deliveries of <br /> medical marijuana that either originate or terminate within the city are expressly <br /> prohibited. <br /> 6.18.040 No permits, licenses or entitlements for medical marijuana. <br /> In addition to the other prohibitions in this Chapter 6.18, no city permits, licenses, zoning <br /> certificates or entitlements shall be issued for any commercial medical marijuana <br /> activities, or other medical marijuana activities, in or upon any premises in the city. This <br /> section is also meant to prohibit all activities for which a State license is required. <br /> 6.18.04530 Penalty. <br /> Any person violating any of the provisions of this chapter shall be subject to <br /> Administrative Citation as provided in Chapter 1.24. <br /> person convicted of a misdemeanor under the provisions of this chaptcr shall be <br /> punished by a fine of not more than $1,000.00 or by imprisonment for a period not <br /> exceeding six months, or by both such fine and imprisonment.
