Section 2-19.10. Additional Regulations. <br /> <br /> In addition to the regulations set forth in this chapter, <br /> the Department of Housing and Community Development, with <br /> the consent of the City Council, may adopt such standards <br /> or regulations as are necessary to protect the public from <br /> seismic hazards. These standards or regulations may be <br /> more stringent than, but shall not be in conflict with, the <br /> provisions of any policies and criteria adopted by the <br /> State Mining and Geology Board pursuant to Section 2623 of <br /> the Public Resources Code of the State of California. Ex- <br /> cept where more stringent standards or regulations have <br /> been adopted, the policies and criteria adopted from time <br /> to time by the State Mining and Geology Board shall apply <br /> within the City of Pleasanton. <br /> <br /> Section 2. Severability. <br /> <br /> The City Council hereby declares that, should any section, <br />paragraph, sentence, or word of this ordinance be declared <br />invalid for any reason, the Council would have passed all other <br />portions of this ordinance independent of the elimination here- <br /> <br />from of any such portion as may be declared invalid. <br /> Section 3. Effective Date. <br /> <br /> This ordinance shall become effective immediately upon its <br />introduction and adoption of a four-fifths vote of the City <br />Council as an urgency measure. <br /> <br /> Section 4. The circumstances creating the urgency are as <br />follows: <br /> <br /> 1. The Alquist-Priolo Geologic Hazards Zone Act (Section <br /> <br /> 2621 et seq. of the Public Resources Code) allows munici- <br /> palities to adopt policies and criteria stricter than those <br /> imposed by the State Geologist. <br /> <br /> 2. The State Geologist promulgated the policies and <br /> <br /> criteria of the State Mining and Geology Board on July 1, <br /> 1974. <br /> <br /> 3. Due to the need to establish local policies and criteria <br /> <br /> the City staff has prepared the above ordinance. <br /> <br /> 4. The potentiality now exists for the resumption of <br /> <br /> new real estate development within the City, and within <br /> areas deemed to be within special study zone maps prepared <br /> by the State Geologist, due to the existence of additional <br /> capacity at the Valley Community Services District plant. <br /> <br /> -4- <br /> <br /> <br />
