mined that the proposed project will be located within a <br /> special studies zone, the Director shall advise the ap- <br /> plicant in writing of his findings and the amount required <br /> to be deposited, pursuant to the City of Pleasanton Reso- <br /> lution Establishing Fees and Charges for Various Municipal <br /> Services, for preparation of a geologic report. Upon receipt <br />of the required fee, the Director shall cause the geologic <br />report to be prepared by a qualified geologist selected <br />by the City. <br /> <br /> Section 2-19.06. Preparation of Report. <br /> <br />The geologic report required by this chapter shall be pre- <br />pared and based on an investigation conducted in accordance <br />with the standard practices and current state of the art <br />used to determine the location, absence and effect of an <br />active fault. Subsurface exploration shall be employed if <br />a lack of distinguishable fault features in the vicinity <br />prevents the qualified geologist from determining from on- <br />site examination, review of available aerial photographs, <br />or by other means whether the standards set forth in Section <br />2-19.04, or other standards established pursuant to this <br />chapter are satisfied. <br /> <br />Section 2-19.07. Waiver and Exception. <br /> <br /> a. Waiver. The Director, based on the advice and re- <br /> commendation of a qualified geologist retained by <br /> the City pursuant to this chapter, is satisfied that <br /> there is sufficient technical information avail- <br /> able from previous geologic studies and reports <br /> to determine that no undue fault hazard exists, <br /> he may waive the requirement that a geologic <br /> report be prepared pursuant to this chapter. <br /> This determination shall be in writing, citing <br /> the reasons for such waiver. <br /> <br /> b. Exception. The requirement of filing a geologic <br /> report may be satisfied for an individual one- <br /> or two-family residence if, in the judgment of <br /> the Director, it has been determined from pre- <br /> vious studies that no undue fault hazard exists. <br /> Written justification for this determination <br /> shall be transmitted by the Director to the State <br /> Geologist for his approval. The exception will <br /> be allowed only upon receipt of the approval of <br /> the State Geologist. <br /> <br />Section 2-19.08. Consid. eration of Report. <br /> <br />The geologic report prepared pursuant to this chapter shall <br />be used by the appropriate City board, commission, council <br />or staff person required to pass upon the new real estate <br />development or structure for human occupancy to aid it in <br />making its decision. The approving body may approve, deny <br />or impose necessary conditions required to protect the public <br />health, safety and general welfare from geologic hazards. <br /> <br />Section 2-19.09. Appeal. <br /> <br />The decision of the approving board, commission or staff <br />person may be appealed pursuant to the applicable appellate <br />provisions set forth in the Ordinance Code. <br /> <br /> <br />
