ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING MUNICIPAL CODE SECTIONS 9.24.040 - PROHIBITION OF <br /> SMOKING IN PUBLIC PLACES, AND 13.08.190 - SMOKING, TO ALLOW <br /> PERSONS HOLDING EVENTS IN THE DOWNTOWN TO ELECT TO HAVE <br /> THEIR EVENTS NON-SMOKING AND PROVIDE THAT VIOLATIONS ARE <br /> SUBJECT TO ADMINISTRATIVE CITATION <br /> WHEREAS, the City Council, upon recommendation of the Pleasanton <br /> Downtown Association, wants to allow persons holding events in the Downtown to have <br /> the option of making their events non-smoking to support public health, community <br /> enjoyment of the Downtown, and further promote family-friendly events; and <br /> WHEREAS, such option will continue to allow persons hosting events geared <br /> towards adults to not be subject to such a restriction; and <br /> WHEREAS, amendments are proposed to the Pleasanton Municipal Code <br /> Chapters 9.24 Smoking in Public and Work Places and 13.08 Parks and Recreation <br /> Facilities to allow for persons holding events to make such a non-smoking choice, and <br /> to make violations subject to administrative citation. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Amends Pleasanton Municipal Code as follows: <br /> Chapter 9.24 SMOKING IN PUBLIC AND WORK PLACES <br /> 9.24.040 Prohibition of smoking in public places. <br /> A. Smoking shall be prohibited in all enclosed public places within the city, including the <br /> following enclosed and unenclosed spaces: <br /> 1. Elevators and restrooms. <br /> 2. Buses, taxicabs and other means of public transit, and ticket, boarding and <br /> waiting areas of public transit depots. <br /> 3. Service lines. <br /> 4. Retail stores, except retail tobacco stores. <br /> 5. Retail food marketing establishments, including grocery stores and <br /> supermarkets. <br /> 6. All areas available to and customarily used by the general public in all <br /> businesses, nonprofit entities and public agencies patronized by the public, <br /> including but not limited to business offices, banks, hotels and motels, except <br /> as provided in subsection (A)(14) of this section. <br /> 7. Restaurants, including: <br /> a. Bars and banquet rooms in, open to or directly accessible from <br /> restaurants; and <br />
