THE CITY OF _ 19 <br /> ( � -^ •' CITY COUNCIL AGENDA REPORT <br /> 971i:1 � ul�t ��w wRl` u � 111 '. <br /> pLEASANTON. <br /> December 15, 2015 <br /> City Attorney <br /> City Manager <br /> Economic Development <br /> TITLE: CONSIDER ADOPTION OF THE PLEASANTON DOWNTOWN <br /> ASSOCIATION'S RECOMMENDATIONS REGARDING SMOKING <br /> RESTRICTIONS FOR EVENTS IN THE DOWNTOWN WITH RELATED <br /> ORDINANCE AMENDING MUNICIPAL CODE SECTIONS 9.24.040 AND <br /> 13.08.190, AND CONSIDER AMENDING CITY COUNCIL WORK PLAN <br /> PRIORITIES TO INCLUDE A STUDY OF SMOKING RESTRICTIONS IN <br /> MULTIFAMILY RENTAL HOUSING <br /> SUMMARY <br /> After adopting a ban on smoking in City parks and trails, the Council requested that the <br /> Pleasanton Downtown Association (PDA) make a recommendation regarding potential <br /> smoking restrictions in the Downtown. The PDA recommends that the City: <br /> (1) allow renters of Downtown facilities to establish event-specific smoking bans; <br /> (2) allow events involving street closures to establish event-specific smoking bans; <br /> (3) ban smoking at City-sponsored events (e.g. Hometown Holidays, etc.); <br /> (4) allow holders of conditional use permits for special events to ban smoking for <br /> their uses; and <br /> (5) enforcement by signage, warnings, and administrative citations. <br /> Related amendments to the municipal code for such smoking restrictions are proposed <br /> for adoption by ordinance. <br /> The Council also requested that staff provide information about: (a) the City's current <br /> smoking restrictions; and (b) consider adding to the Council Work Plan Priorities a study <br /> on smoking restrictions in multifamily rental housing. A resident has also asked for <br /> smoking restrictions in single family neighborhoods. <br /> RECOMMENDATION <br /> Adopt the recommendation of the PDA to allow persons holding Downtown events (via <br /> rental, street closure, or conditional use permit) to be allowed to chose to ban smoking <br /> at their events; and ban smoking at City events Downtown. Introduce an ordinance <br /> amending the municipal code to codify such option for events to be non-smoking. <br /> Consider amending the Council Work Plan Priorities to include a Study of Smoking <br /> Restrictions in Multifamily Rental Housing. Provide staff direction about smoking <br /> restrictions in single family neighborhoods. <br />
