BACKGROUND <br /> On January 10, 2012, the City Council adopted Ordinance No. 2030 that rezoned the <br /> CM Capital properties which included 5850 West Las Positas Boulevard, the project <br /> site. <br /> On March 18, 2014, the City Council adopted Ordinance No. 2090 approving PUD-81- <br /> 30-88D an application by SHAC Las Positas Apartments LLC to construct 177 <br /> apartment units and related site improvements at the property located at 5850 West Las <br /> Positas Boulevard. <br /> On May 13, 2015, the Planning Commission considered a modified proposal submitted <br /> by the project applicant. Instead of constructing 177 for rent apartment units, the <br /> applicant proposed 94 for sale condominium units and related improvements. On June <br /> 16, 2015, the City Council adopted Ordinance No. 2121 approving PUD-81-30-89D, an <br /> application by SummerHill Homes for a major modification to an approved PUD to <br /> construct 94 condominium units and related site improvements at the property located <br /> at 5850 West Las Positas Boulevard. <br /> On June 26, 2015, the Planning Commission approved the Vesting Tentative Map for <br /> Tract 8246 to divide the property and create the for sale condominiums <br /> The developer, SummerHill Homes, has now provided the required disclosure deed, <br /> agreements, Final Map, Improvement Plans, and other legal documents for Tract 8246. <br /> The Engineering staff, Planning staff, and the City Attorney's Office have reviewed <br /> these documents and have found them to be in substantial compliance with the <br /> approved Vesting Tentative Map. <br /> DISCUSSION <br /> Proposed Improvements and Maintenance Responsibility <br /> The sanitary sewer mains, water mains and water laterals up to the water meters will be <br /> located within public service easements in the private streets. These utilities will be <br /> operated and maintained by the City. <br /> The development proposes that all streets within the proposed subdivision shall be <br /> private. The sanitary sewer laterals, storm drain system, storm water biotreatment <br /> facilities, and the private streets and driveways will be the responsibility of the project <br /> Homeowner Association (HOA). The HOA will be responsible for preparing and <br /> submitting annual reports as required in the Storm Water Operation and Maintenance <br /> agreement. The project Covenants, Conditions and Restrictions (CC&Rs), to be <br /> recorded concurrently with the Final Map, will identify all improvements to be maintained <br /> by each condominium owner and the HOA. <br /> Page 2 of 3 <br />
