told me Pleasanton had an hillside preservation ordinance already in 2006 and that it is
almost identical to the Walnut Creek hillside ordinance. I confirmed in the city records that
it was passed by the city council and it exists.
•. Regarding the initiative, Kay Ayala proposed a portion of the initiative be a clause
reducing the housing cap from 29,000 to 28,000 units and that the initiative be called the
Slow Growth initiative. She indicated that Tom Pico had overstated the housing cap
number to account for 2,000 units on the Bernal Property. The language Kay suggested
was dropped.
5. Exceptions were discussed in relation to the ridgeline /hillside protection portions of the
proposed initiative. The exact roadway exception in the San Juan Capistrano ordinance
was discussed and circulated in email. Though they saw language in other city initiatives
that have roadway exceptions, Steve and Kay never asked that any roadway
exception or exemption be included in the initiative.
6. I researched and compiled the series of state, a southern California and local East Bay
ridgeline preservation ordinances in anticipation of the Planning Commission agenda item
that was never placed on the agenda for the Planning Commission. Several of these local
ordinances and one state one were selected as ones appropriate for the initiative.
7. It was my idea to have the definition of a housing unit and the 'waiver' language in the
initiative. Steve was one of the participants in that series of sentences in the initiative.
8. In a review of my emails, Steve edited the definition of the housing unit multiple times
taking away the language that Brian and I put in there several times that indicated housing
units should not count 'second units.'
Paper handouts on voting Yes on Measure PP distributed to about 20,000 houses prior
the November 2008 election say "a mile long road spanning the top of many of our
Southeast Hills." A green Measure PP and QQ Fact Check sheet also does not mention
any exemption for roads.
Anne Fox
Original Message ---
From: Anne Fox
To: steve(abrozoskv.com
Sent: Friday, September 07, 2007 9:20 PM
Subject: Ridgeline— Novato, San Juan Capistrano
...personally I think that we need to have the primary ridgetops in the SE Hills declared a series of General Plan
'ridgelines,' plop in the 200 ft grading limitation in San Juan Capistrano pretty much word for word, and blend it with the
25% gross developable acres, and the sillhouette language and roof must be X feet below ridge like in Novato.
A reader's digest version of these two would work nicely and they have held up to challenges already.
Anne
CITY OF SAN JUAN CAPISTRANO
litc. 9- 3.411. Ridgeline and Open Space Preservation (RP) District.
Intent and purpose. The intent of thin section is to establish grading and construction zoning controls for the purpose of
implementing preservation of ridgeline goals as stated in the Conservation and Open Space Element of the General Plan.
2
