shown in Option 2 of the June 24, 2015 staff report requiring project access to be from <br /> Sunset Creek Lane only, with the 24-foot road option without retaining walls as <br /> described in the August 26, 2015 staff memo. The recommendation included the <br /> following modifications to the Conditions of Approval: modify Condition No. 14 <br /> regarding setbacks; Condition No. 55 regarding use of existing wells during <br /> construction; and Condition No. 105 regarding water meter requirements. The Planning <br /> Commission also added three conditions to mandate the use of recycled water for all <br /> dust control; to further document areas of man-made slopes; and to restrict the <br /> proposed home on Lot 32 to a single story. <br /> RECOMMENDATION <br /> Staff recommends that the City Council: <br /> 1. Find that the Final Environmental Impact Report (EIR) conforms to the California <br /> Environmental Quality Act (CEQA); <br /> 2. Find that the proposed Planned Unit Development (PUD) Rezoning and <br /> Development Plan, and the Development Agreement are consistent with the <br /> General Plan; <br /> 3. Adopt a resolution certifying the Final EIR as complete and adequate <br /> (Attachment 1); <br /> 4. Adopt a resolution approving the CEQA Findings and the Mitigation Monitoring <br /> and Reporting Program (Attachment 2); <br /> 5. Adopt a resolution approving the Affordable Housing Agreement (Attachment 4); <br /> 6. Introduce the draft ordinance approving the Development Agreement to vest <br /> entitlements for the project (Attachment 5). <br /> 7. Adopt a resolution approving the Growth Management Agreement <br /> (Attachment 6); <br /> 8. Make the PUD findings for the proposed Development Plan as stated in the <br /> June 24, 2015 Planning Commission staff report (pages 35-39 in Attachment 8); <br /> and <br /> 9. Introduce the draft ordinance approving Case PUD-25, the PUD Rezoning and <br /> Development Plan, revised to be consistent with Option 3 described in the <br /> June 24, 2015 Planning Commission staff report, "Approve a revised project that <br /> divides the project into two separate areas, each accessed through a different <br /> neighborhood," subject to the Conditions of Approval listed in Exhibit A <br /> (Attachment 3). <br /> Page 2 of 26 <br />
