Chair Allen inquired it the Commission could do it in two parts then: have a basic vote <br /> on the options first and if it passes, add the conditions as a second vote with any <br /> additional conditions or modifications. <br /> Mr. Dolan replied that the Commission can do whatever it wishes. He added that the <br /> Commissioners and everyone in the room should probably know what happens if there <br /> is a 2-2 vote. He indicated that Ms. Harryman can address that. <br /> Ms. Harryman stated that the Commissioner's Handbook actually contemplates a 2-2 <br /> vote when there is an absence, and Commissioner Ritter is absent tonight. She <br /> indicated that if there is a 2-2 vote, a tie vote on a motion shall be carried forward to the <br /> next meeting at which all Commissioners are present. She stated that she does not <br /> know the Commissioners' schedules and it everyone is available for the next meeting. <br /> Mr. Dolan noted that there will not be a full Commission until August. <br /> Commissioner Piper asked Commissioner Balch if he wanted to share his thoughts on <br /> where he stands. <br /> Commissioner Balch stated that he is debating the question of what the community <br /> wants, that there are 20 years of PUD precedence saying the road was going over the <br /> hill, and an abrupt course correction by the voters through a ballot amendment process <br /> possibly corrected too far. He added that the difficulty is how to equip himself into the <br /> status of all of the voters, and if he is qualified to do that. <br /> Commissioner Nagler stated that his 6th grade teacher asked him a really good <br /> question: When you're elected to Congress, is your job always to vote the will of the <br /> majority of your district or is your job to try to interpret to the best of your ability what is <br /> best for your district? <br /> Commissioner Balch replied that his answer would change based upon what he would <br /> like the outcome to be if he were a United States Congressman. He stated that he <br /> thought he was going to be an excellent umpire in the Little League, and he turned out <br /> to be the worst and should never have tried to umpire. He stated that he worries in <br /> general about Initiative-based legislated processes because he believes voters are told <br /> something before leading up to the vote: This is going to save the hills and there will be <br /> nothing ever built, and the voter will take what that solicitor says to them maybe a little <br /> bit of too much on face value, and the next thing is that on paragraph 30 or page 6, <br /> there is something that was not intended, and the pendulum swings a little too far and it <br /> kind of rudders back out to the middle over time. <br /> Commissioner Balch stated that he worries that Measures PP and QQ interpreted too <br /> rigidly would do that to Pleasanton, and he thinks that he has to believe in some regard <br /> that 20 years of precedent that this is going over the hill is a fairly consistent rudder that <br /> he has adapted to, and now he is asking how he gets there with his interpretation of <br /> what a structure is, and in terms of what he thinks, how he can say the vote was too far <br /> for the interpretation. He continued that 20 years is a significant amount of time of <br /> planning, and the best-laid plans were to go over the hill.
