Annexation Procedures <br /> At this meeting, Council will formally decide whether to request LAFCo to take action on <br /> the annexation and enter into a tax sharing arrangement with the County. If City Council <br /> supports the subject annexation, the City Council would be taking the following actions: <br /> 1. Adopt a resolution formally initiating the annexation with LAFCo; and <br /> 2. Adopt a resolution agreeing to the exchange of property taxes with Alameda <br /> County by authorizing the City Manager to execute a property tax sharing <br /> agreement in a form approved by the City Manager and City Attorney. <br /> If Council decides to initiate annexation proceedings, an annexation application is <br /> submitted by the City to LAFCo staff for its review. Once LAFCo staff is satisfied that all <br /> requirements have been completed, the annexation is scheduled for a public hearing for <br /> action by LAFCo. At the hearing, LAFCo will review the staff report and factors related to <br /> the annexation, testimony of the public agency and general public, service plan, and <br /> environmental review documents. LAFCo may approve the annexation with either <br /> revisions or conditions; it may also decide not to approve the annexation. <br /> If there is 100% consent by the property owners', LAFCo may proceed to approve the <br /> application without an additional hearing. LAFCo will then order the change in <br /> organization. The annexation becomes effective when it is formally recorded with <br /> Alameda County. <br /> Tax Sharing Agreement <br /> Staff also recommends Council adopt a resolution authorizing the City Manager to <br /> execute a property tax sharing agreement with the County for the distribution of property <br /> taxes in a form approved by the City Manager and City Attorney. <br /> The County Board of Supervisors must also approve the tax sharing agreement. This <br /> item will be scheduled for the County Board of Supervisors meeting after City Council <br /> adopts a resolution agreeing to the exchange of property taxes. The three parcels will <br /> be incorporated into the City's tax rate area after the completion of the annexation. <br /> Under the tax sharing agreement, the City would receive an allocation of the computed <br /> property tax revenue equivalent to the average City-wide share of property tax it receives <br /> each year. The proposed tax-sharing split would give the City the same percentage it <br /> receives on average, City-wide, which is approximately 25% of the 1% property value <br /> based tax rate received by the County each year. This proposed tax-sharing agreement <br /> has been used with the City's more recent annexations. <br /> PUBLIC NOTICE <br /> Property owners within a 1,000-foot radius of the sites to be annexed have been notified <br /> that the City Council will be considering this annexation. A noticing map is attached as <br /> As noted earlier, all of the owners of the three subject parcels are expected to consent to annexation: <br /> Ms. Linfoot as the applicant, and the Marks and the Mixes based on their prior agreement to support <br /> annexation in exchange for being allowed to connect to City utility services. <br /> Page 5 of 6 <br />
