Pleasanton Civic Center Master Plan Proposal <br /> October 6,2015 <br /> thirty days after date of invoice. Any required initial deposit made upon execution of <br /> this agreement shall be credited to the Owner's account at final payment. <br /> VIII. LIMITATION OF LIABILITY: <br /> The Owner agrees to limit the Architect's liability to the Owner and to all construction <br /> contractors and subcontractors on the project,due to the Architect's negligent acts, <br /> errors or omissions,such that a total aggregate liability of the Architects to all those <br /> named shall not exceed Fifty Thousand Dollars($50,000.00)or the Architect's total <br /> fee for services rendered on this project, whichever is greater. <br /> IX. HAZARDOUS MATERIALS: <br /> In the event Architect or any other party encounters hazardous materials in any form <br /> at the Project site, including but not limited to asbestos,asbestos products, <br /> polychlorinated biphenyl (PCB)or other toxic substances,or should it become known <br /> in any way that such materials may be present at the Project site or any adjacent <br /> areas that may affect the performance of Architect's services,the Architect shall <br /> immediately notify the Owner. The Owner shall retain appropriate specialist <br /> Consultant(s)or contractor(s)to identify, abate and/or remove the hazardous <br /> materials, and warrant that the Project site is in full compliance with applicable laws <br /> and regulations. Architect shall not be responsible in any way for any safety <br /> precautions, including without limitation, measures for the protection of the <br /> contractor or any subcontractor, nor for the protection of the public. Such <br /> responsibility for safety precautions is and shall remain that of the Owner and its <br /> specialist Consultant(s)and contractor(s). In the event hazardous materials, in any <br /> form, are encountered or found at the Project site or in any adjacent areas that may <br /> affect the performance of the Architect's services, said circumstances will constitute a <br /> changed condition thereby entitling Architect to renegotiate its contract with Owner <br /> to include a waiver, hold harmless and indemnity protection in connection with <br /> hazardous materials, in any form,at the Project site. <br /> PO glat' <br /> PA@ LA <br />
