Pleasanton Civic Center Master Plan Proposal <br /> October 6,2015 <br /> A. Expense of transportation* and living when traveling in connection with the <br /> Project; (when travel time exceeds four hours in flight time,all travel will be <br /> business class); conference call services,and fees paid for securing approval <br /> of authorities having jurisdiction over the project. <br /> When renting cars for business travel, Field Paoli does take the rental company's Loss <br /> Damage Waiver(LDW) and Collision Damage Waiver(CDW) and charges this as part of <br /> the transportation expense. <br /> B. Expense of reproductions including computer plotting, postage, overnight <br /> priority mail and handling of Drawings and Specifications. <br /> C. If authorized in advance by the Owner,expense of overtime work requiring <br /> higher than regular rates and expense of renderings or models for the <br /> Owner's use. <br /> IV. COST ESTIMATES: <br /> Estimates by the Architect represent its best professional judgment of probable cost. It is <br /> recognized, however,that neither the Architect nor the Owner has any control over the <br /> Contractor's methods of determining bid prices or variable market conditions. Thus,the <br /> Architect cannot guarantee that bids will not vary from its estimate. <br /> V. TERMINATION: <br /> If,for any reason,the Architect's services are terminated or this project is abandoned,the <br /> Architect shall be compensated for Principals'time and Employees'time and other <br /> charges as noted above, up to and including the date of termination. Owner may <br /> terminate this agreement at any time without cause. In the event the Owner terminates <br /> this agreement prior to completion of the Architect's services,the Owner agrees to <br /> indemnify, hold harmless and defend the Architect, its employees and consultants,from <br /> any and all claims, damages,demands and legal costs which may arise from the use of the <br /> Drawings or Specifications,except those claims for which the Architect is held solely <br /> liable. <br /> VI. OWNERSHIP OF DOCUMENTS: <br /> Drawings and Specifications as instruments of services are,and shall remain,the <br /> property of the.Architect whether or not the project for which they are made is <br /> executed. <br /> VII. PAYMENTS: <br /> Invoices for service shall be rendered monthly, in proportion to the amount of work <br /> completed and are due upon receipt(three days after postmark). The Architect <br /> Ong112' reserves the right to stop work when charges are more than thirty(30)days past due. <br /> Interest will be charged on all unpaid bills at 10%per annum and will be accrued <br /> Pk®Dd <br />
