the City of Pleasanton by changing the last paragraph of said section to read as follows: "The Director of Housing and Community Development or his designated representative shall reject a tentative map if the information required above is not included upon said map. The Review Board shall reject a minor subdivision map if the information required above, which is applicable is not included upon said map. In the event of such rejection, the proposed subdivider shall be notified as soon as possible in writing." 5. Section 2-2.50 (Planning Commission Action), Articles4 Chapter 1, Title II of the Ordinance Code of the City of Pleasanton is amended to change the time period referred to therein from "forty (40)" to "fifty (50)" days. Section 6. This ordinance shall become effective immediately upon its passage and adoption pursuant to §36937 of the Goverr ment Code in order to clarify provisions of the City Sub- division ordinance in line with existing law. Section 7. The facts constituting the need for this ordinance as an urgency measure are as follows: 1. The said Subdivision Map Act, effective as of March 1, 1975, is now contained in the Government Code and not in the Business and Professions Code, and thus, it is necessary to clarify provisions of the City Subdivision Ordinance in order to insure tha there is no conflict between the provisions of said ordinance and that of State law. 2. The provisionsof the'Environmental~lityAct require the evaluation'of a project onenvironmental grounds and prepara- tion of the pertinent environmental document (i.e. either a negative declaration or an environmental impact report)before a project may be approved. The State Subdivision Map Act, however, provides that a 1 City must act on a tentative map once it has been filed within 50 days of said filing or the map shall be deemed approved. -2-
