the City of Pleasanton by changing the last paragraph <br /> of said section to read as follows: <br /> <br /> "The Director of Housing and Community Development <br /> or his designated representative shall reject a <br /> tentative map if the information required above is <br /> not included upon said map. The Review Board shall <br /> reject a minor subdivision map if the information <br /> required above, which is applicable is not included <br /> upon said map. In the event of such rejection, the <br /> proposed subdivider shall be notified as soon as <br /> possible in writing." <br /> <br /> 5. Section 2-2.50 (Planning Commission Action), Articles4 <br /> Chapter 1, Title II of the Ordinance Code of the City of <br /> Pleasanton is amended to change the time period referred <br /> <br />to therein from "forty (40)" to "fifty (50)" days. <br />Section 6. This ordinance shall become effective immediately upon <br /> <br /> its passage and adoption pursuant to §36937 of the Goverr <br /> ment Code in order to clarify provisions of the City Sub- <br /> division ordinance in line with existing law. <br /> <br />Section 7. The facts constituting the need for this ordinance as <br /> <br /> an urgency measure are as follows: <br /> <br /> 1. The said Subdivision Map Act, effective as of <br /> March 1, 1975, is now contained in the Government <br /> Code and not in the Business and Professions Code, <br /> and thus, it is necessary to clarify provisions of <br /> the City Subdivision Ordinance in order to insure tha <br /> there is no conflict between the provisions of said <br /> ordinance and that of State law. <br /> <br /> 2. The provisionsof the'Environmental~lityAct require the <br /> evaluation'of a project onenvironmental grounds and prepara- <br /> tion of the pertinent environmental document (i.e. <br /> either a negative declaration or an environmental <br /> impact report)before a project may be approved. The <br /> State Subdivision Map Act, however, provides that a <br /> <br /> 1 <br /> City must act on a tentative map once it has been <br /> <br /> filed within 50 days of said filing or the map shall <br /> be deemed approved. <br /> <br /> -2- <br /> <br /> <br />
