and Professions Code Section 11010 and Civil Code Sections 1102.6, 1103.4, <br /> and 1353. <br /> 39. In accordance with measure NO-1.1, prior to the City's issuing of building permits <br /> for the project, the project developer shall submit to the City noise analyses <br /> prepared by a qualified acoustical consultant that demonstrates that all <br /> structures will meet City interior noise level standards. All proposed structures <br /> where people will reside will need to not exceed the City's interior noise level <br /> standard of 45 dBA Ldn. Noise reduction features may include, but are not <br /> limited to, building siting, upgraded insulation, sound rated windows and doors, <br /> sound rated exterior wall assemblies, and acoustical caulking. <br /> 40. In accordance with measure NO-1.2, prior to the City's issuing of building permits <br /> for the project, the project developer shall submit to the City noise analyses <br /> prepared by a qualified acoustical consultant that demonstrates that all structures <br /> where people will sleep will meet the City standard for single-event noise levels <br /> (i.e., the maximum sound levels (Lmax) would not exceed 50 dBA in all rooms <br /> where people will sleep and 55 dBA in all other habitable rooms. Noise reduction <br /> features may include, but are not limited to, building siting, upgraded insulation, <br /> sound rated windows and doors, sound rated exterior wall assemblies, and <br /> acoustical caulking. <br /> 41. In accordance with measure NO-3.1, the project developer shall implement <br /> construction best management practices, including the following, to reduce <br /> construction noise: <br /> a. Locate stationary construction equipment as far from adjacent occupied <br /> buildings as possible. <br /> b. Select routes for movement of construction related vehicles and <br /> equipment so that noise sensitive areas, including residences, and <br /> outdoor recreation areas, are avoided as much as possible. Include these <br /> routes in materials submitted to the City of Pleasanton for approval prior to <br /> the issuance of building permits. <br /> c. All site improvements and construction activities, except site grading, shall <br /> be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through <br /> Saturday. Site grading shall be limited to the hours of 8:00 a.m. to 5:00 <br /> p.m. Monday through Friday. In addition, no construction shall be allowed <br /> on State and Federal holidays. If complaints are received regarding the <br /> Saturday construction hours, the Director of Community Development may <br /> modify or revoke the Saturday construction hours. The Director of <br /> Community Development may allow earlier "start times" for specific <br /> construction activities (e.g., concrete foundation/floor pouring), if it can be <br /> demonstrated to the satisfaction of the Director of Community <br /> Development that the construction and construction traffic noise will not <br /> affect nearby residents. <br /> d. All construction equipment must meet Department of Motor Vehicle (DMV) <br /> noise standards and shall be equipped with muffling devices. <br /> 9 <br />
