DISCUSSION <br /> The regulations implementing the California Public Employees' Retirement Law were <br /> changed to require that pay schedules of employees be approved by the governing <br /> body of each CaIPERS agency. While Pleasanton's practices for most of its employees <br /> comport with this requirement as pay scales are attached to Memoranda of <br /> Understanding approved by the City Council for each bargaining group, confidential and <br /> management employees have been handled differently with the Management <br /> Compensation Plan being approved by the City Manager and referenced in the budget <br /> adopted by the Council. It is important to bring Pleasanton's practice for this group of <br /> employees into conformity with State regulations by having the City Council approve the <br /> current pay schedule at a public meeting. Thus, ratification of the City's pay schedules <br /> for the periods effective September 3, 2011, September 1, 2012, December 7, 2013 and <br /> September 13, 2014 is appropriate at this time. <br /> Finally, staff will bring the entire Management Compensation Plan to the City Council for <br /> its review and approval in the future. However, one issue requires City Council approval <br /> now to protect the city's financial interests and to ensure there are no <br /> misunderstandings regarding ineligibility for retiree medical benefits for employees that <br /> retire from Pleasanton and then go to work for another CaPPERS member agency. The <br /> amended language, set forth in the Management Compensation Plan dated September <br /> 15, 2014, for which Council approval is sought reads as follows: <br /> "5.3 Retire Medical Benefit Eligibility <br /> Employees who retire from the City of Pleasanton (i.e. under the CaIPERS <br /> retirement system, Government Code Section 20000 et seq.) are eligible for <br /> retiree medical benefits. Retirement from Pleasanton means a retirement <br /> effective date through PERS no more than 120 days after separation from the <br /> City of Pleasanton.
