12 <br />ORDINANCE NO. 2123 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF SHAC LAS POSITAS APARTMENTS <br />LLC FOR A PUD MAJOR MODIFICATION TO AMEND THE HOUSING SITE <br />DEVELOPMENT STANDARDS AND DESIGN GUIDELINES FOR SITE #9 TO <br />SPECIFICALLY CHANGE THE MINIMUM AND MAXIMUM DENSITY FROM <br />THE REQUIRED 30 DWELLING UNITS /ACRE TO 15.9 DWELLING <br />UNITS /ACRE FOR THE 5.9 ACRE SITE LOCATED AT 5850 W. LAS POSITAS <br />BOULEVARD, AS FILED UNDER PUD- 81- 30 -55M <br />WHEREAS, SHAC Las Positas Apartments LLC has applied for Planned Unit <br />Development (PUD) Major Modification to amend the Housing Site Standards and <br />Design Guidelines for Site #9 to specifically change the minimum and maximum density <br />from the required 30 dwelling units /acre to 15.9 dwelling units /acre for the construction <br />of 94 condominium units and related site improvements at 5.9 -acre site located at 5850 <br />West Las Positas Boulevard (the "Project "); and <br />WHEREAS, zoning for the property is Planned Unit Development — Mixed Use <br />(PUD -MU) District; and <br />WHEREAS, the Planning Commission at its regular meeting on May 13, 2015 <br />adopted Resolution PC- 2015 -11, determining that the proposed PUD major modification <br />is appropriate for the site, making findings, and recommending to the City Council that <br />PUD -81 -30 -55M be approved; and <br />WHEREAS, on June 16, 2015, the Pleasanton City Council held a duly noticed <br />public hearing on this application and considered all public testimony, agenda reports, <br />and related materials, and the recommendations of City staff and the Planning <br />Commission; and <br />WHEREAS, the City Council determined that the conditions described in <br />California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br />occurred and finds that the previously prepared Supplemental Environmental Impact <br />Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br />Considerations in City Council Resolution 12 -492, and the Addendum to the SEIR for <br />the Project and SHAC (SummerHill Home) Las Positas Townhome Condominiums — <br />CEQA Addendum Substantial Conformity memo are adequate to serve as the <br />environmental documentation for the Project and satisfy all the requirements of CEQA; <br />and <br />WHEREAS, the Pleasanton City Council finds that the proposed PUD <br />development plan is consistent with the City's General Plan and purposes of the PUD <br />ordinance. <br />
