will perform the archaeological monitoring program and prepare a technical report for <br />Caltrans review and approval. <br />This seventh amendment will not cover any process that will be undertaken if a <br />substantially intact, significant cultural deposit is exposed during the test program or <br />during construction. If this occurs, consultation with Caltrans will be necessary and the <br />archaeological data recovery of the mitigation plan will need to be initiated. The cost for <br />archaeological data recovery cannot be accurately estimated as it is dependent on what <br />is found. However due to work recently completed in the area associated with Stage 1 <br />of the project we believe the likelihood of a discovery to be minimal. If archaeological <br />data recovery is required, the data recovery will proceed per the mitigation plan and <br />staff will request City Council's approval for another amendment to BKF's agreement to <br />include archaeological data recovery. <br />During construction, the design services of BKF Engineers will be needed to respond to <br />requests for information from the contractor, review contractor submittals, provide <br />archaeological monitoring, and attend meetings as required. After construction is <br />completed, BKF will also prepare the construction record drawings. These additional <br />services are additional work that was not included in the original scope of services. <br />The scope of services and fee proposal ($97,100) for the seventh amendment to the <br />professional services agreement with BKF Engineers is presented in Attachment 3. <br />Construction Management and Inspection Services <br />This project is located within Caltrans right of way and requires Caltrans experienced <br />construction management and inspection staff to meet the requirements of a Caltrans <br />encroachment permit. City staff is capable of performing the needed construction <br />management and inspection services, but it is very time consuming. Due to numerous <br />projects under construction including Bernal Park Phase II, the annual street <br />rehabilitation project, the soon to begin recycled water project, and the Arroyo Mocho <br />trail paving project, staff contacted our as- needed general engineering consultants <br />Pakpour Consulting Group, Inc. to assist with the workload. Staff determined that <br />Pakpour Consulting Group, Inc., along with their subcontractor The Hanna Group, have <br />the required Caltrans experience and can provide the construction support services for <br />this project. City staff will be closely supervising the work of these consultants as the <br />project is constructed. <br />Budget <br />A summary of the project budget is presented in Attachment 4. BIC made a lump sum <br />payment to the City for $4.5M to meet their remaining obligation for the Bernal <br />Interchange Improvement, and staff is recommending appropriation of $1,239,867 to <br />cover the total project cost. <br />Staff recommends that the construction contingency percentage for this project be set at <br />$177,000 (approximately 20% of the contract amount) for necessary related project <br />work. Staff recommends this level of contingency due to the archaeological concerns in <br />the Bernal area. <br />Page 4 of 5 <br />
