Name of Recipient <br /> Agreement No.: XX-XXX-550 <br /> Project No.: C-06-XXXX-XXX <br /> agency. the amount, type of assistance(grants, loans, etc.), and a description of the <br /> facilities, components, and items the funds were used for; list the power and maintenance <br /> costs associated with the Project for the period, indicate current plans and programs for <br /> use of any Project capacity not under contract, summarize Project financial experience, <br /> describe compliance with any special conditions of this Agreement; describe direct and <br /> indirect benefits of the project to the state/local water supply and economy; describe other <br /> benefits and challenges arising from the project; and provide such other information as may <br /> be reasonably required to evaluate Project benefits and use of Project facilities. <br /> 2.17 Federal Disadvantaged Business Enterprise(DBE) Reporting. <br /> The Recipient agrees to report DBE utilization to the Division on the DBE Utilization Report, State Water <br /> Board Form DBE UR334. The Recipient must submit such reports to,tlie Division annually within ten (10) <br /> calendar days following October 1 until such time as the"Notice of Completion" is issued. The Recipient <br /> agrees to comply with 40 CFR§ 33.301. A <br /> 2.18 Records. ' <br /> (a) Without limitation of the requirement to maintain Project accounts in.accordance with generally <br /> accepted accounting principles, the Recipient agrees to: " <br /> \ <br /> (1) Establish an official file for the Project which.hall adequately document all'significant <br /> actions relative to the Project;`., \ / ' <br /> (2) Establish separate accoun s.whidh-wiltadequately and'accurately depict all amounts <br /> received and expended on the,Ptojedt including all assistance funds received under this <br /> Agreement; , —� 1 ��. ''� A� <br /> / . 1 ; <br /> (3) Establish/separate accounts which will adequately depict.all income received which is <br /> attributable to the Project,'specifically)ncluding any income attributable to assistance funds <br /> disbursed under this Agreeent; <br /> A �' <br /> (4):Es'tablish.an accounting system which will accurately depict final total costs of the Project, <br /> including both direct.and indirect costs <br /> ti <br /> (5).Establish such.accounts`andrmaintain such records as may be necessary for the State to <br /> fulfill federal reporting requirements, including any and all reporting requirements under <br /> federal tax statutes,or'regulations; and <br /> (6) If Force Account is used(by the Recipient for any phase of the Project, other than for <br /> planning;design, and construction engineering and administration provided for by <br /> allowance>accounts'wili'be established which reasonably document all employee hours <br /> charged to the Project and the associated tasks performed by each employee. Indirect <br /> Force Account'costs are not eligible for funding. <br /> (b) The Recipient shall be required to maintain separate books, records and other material relative <br /> to the Project. The Recipient shall also be required to retain such books, records, and other <br /> material for itself and for each contractor or subcontractor who performed work on this project for <br /> a minimum of thirty-six (36) years after Project Completion. The Recipient shall require that such <br /> books, records, and other material be subject at all reasonable times (at a minimum during <br /> normal business hours) to inspection, copying, and audit by the State Water Board, the Bureau <br /> of State Audits, the United States Environmental Protection Agency (USEPA), the Office of <br /> Inspector General, the Internal Revenue Service, the Governor, or any authorized <br /> representatives of the aforementioned, and shall allow interviews during normal business hours <br /> of any employees who might reasonably have information related to such records.
