Vice Mayor Brown asked how many employees work in Mr. Rudick's office. <br /> Mr. Rudick said 19, including tenants. <br /> Vice Mayor Brown asked and Mr. Rudick confirmed that 5 private offices, in which sometimes sensitive <br /> and private issues are discussed, shared an adjoining wall with the proposed project site. <br /> Vice Mayor Brown asked Mr. Rudick to elaborate on the lack of supervision he witnessed at the Newark <br /> facility. <br /> Mr. Rudick explained that he waited in the lobby for approximately 10 minutes before being <br /> acknowledged by any member of staff, noting that the facility does not employ door alarms. During his <br /> tour he noticed that a rear door ajar. When he asked whether clients had ever left the premises <br /> unannounced, he was told that it happens often but that other tenants are very helpful and alert SVS <br /> staff. He reiterated his concern that some clients may be violent unbeknownst to SVS staff and that the <br /> proposed location is immediately situated next to a very busy and high speed street. <br /> Vice Mayor Brown asked if Mr. Rudick commonly speaks to the Council regarding issues with adjacent <br /> suite neighbors. <br /> Mr. Rudick explained that this is the first instance and again, his issue is with site selection not SVS. <br /> Vice Mayor Brown asked if Mr. Rudick believed the sound attenuating insulation would solve his issue. <br /> Mr. Rudick said he could not speak to the efficacy but noted that noise was not his only concern. <br /> Brock Roby stated that he was speaking on behalf of himself and his son Barrett rather than as a <br /> representative of the Human Services Commission. He disclosed a personal friendship with Peter <br /> MacDonald but said he was unaware of his affiliation with SVS. Additionally, he had no personal <br /> knowledge of SVS' program. As a parent of an adult with developmental disabilities he stressed the <br /> need for and value of this type of program in the community and the desire for families like his to be <br /> included in the community without prejudice. He explained that Barrett attends a very similar program in <br /> Livermore which is located in Class B office space within a business park and looks no different from <br /> any number of other very nice businesses in town. He thanked staff for their work and the Council for <br /> their consideration and said he was confident in the security provided by the conditions of approval and <br /> the judgment of the Planning Commission. <br /> Mayor Thorne closed the public hearing. <br /> Councilmember Pentin said he is personally acquainted with several special needs families in town and <br /> has a very dear friend who is flourishing as a working individual because of a program similar to SVS. <br /> Aside from any personal bias that may exist from that, he said he could find no reason to deny the <br /> application on a land use basis. <br /> Councilmember Olson said he was confident that the various recourse options available to the CUP <br /> process would be a reasonable and effective way to address any difficulties encountered by the <br /> appellant once the project becomes operational. He agreed with the decision to incorporate a decibel <br /> standard. <br /> Councilmember Narum stated that one of the purposes of a conditionally permitted use is to allow for <br /> the application of conditions in order to address the types of concerns Mr. Rudick raised, some of which <br /> are legitimate. She said she appreciated staffs efforts, particularly with the modified condition regarding <br /> noise standards.
