a bonding company stating such bonding company's commitment to issue to Developer <br /> performance, labor& material, and maintenance bonds for the public and subdivision <br /> improvements for Tract 7660 in general conformance with the requirements of Pleasanton <br /> Municipal Code §19.24.080. Such letter shall be in a form and for amounts reasonably <br /> determined as adequate by the City Engineer, or his or her designee. <br /> Developer may provide alternate security in the form of a letter of credit or cash deposit, as <br /> provided by Pleasanton Municipal Code §19.24.080, and as reasonable approved by the City <br /> Attorney, or his or her designee. <br /> 2. Council Action. The City's execution of this Agreement does not alter the City Council's <br /> authority pursuant to Pleasanton Municipal Code §19.24.050 to approve or disapprove the final <br /> map for Tract 7660. <br /> 3. Escrow. If the City Council approves the final map for Tract 7660, an escrow account <br /> with a title company approved by all parties will be established, and the following documents <br /> and other items shall be deposited into such escrow: <br /> a. Final map for Tract 7660 executed by Owners and other appropriate parties, after <br /> approval by the City Engineer and certification by City Clerk; <br /> b. Grant deed from Owners to Developer for Lots 1 — 10, inclusive, and Parcels B, C, D- <br /> 1 and D-2 of Tract 7660; <br /> c. Developer's payment to Owners for portions of Property being granted to Developer; <br /> d. Disclosures, agreements, and other documents required to be recorded against all or <br /> portions of the Property by PUD-05, the Vineyard Avenue Corridor Specific Plan, <br /> and any other City approvals for the Property; <br /> e. Subdivision improvement agreement executed by Developer for Tract 7660 in a form <br /> approved by the City Engineer or his or her designee; <br /> f. Bonds, cash deposits, fees and other securities deposited by Developer into escrow to <br /> meet the requirements of the Tract 7660 Subdivision Improvement Agreement as <br /> reasonably determined by the City Engineer or his or her designee; and <br /> g. Escrow instructions approved by all parties to provide that once all of the required <br /> documents and deposits are received into escrow, the title company may sequentially <br /> record the final map for Tract 7660, the grant deed from Owners to Developer, record <br /> other documents, and release funds, deposits, fees, other securities and agreements. <br /> h. The parties agree that escrow must be completed within forty-five (45)days of the <br /> City Council's approval of a final map for Tract 7660, if so approved as provided in <br /> Section 2, above. <br /> Agreement for Final Map Approval without Improvement Agreement or Bonds—Tract 7660,Silver Oaks Estates Page 2 of 4 <br />
