ATTACHMENT 2 <br /> Agreement for Final Map Approval Without Improvement Agreement or Bonds <br /> Tract 7660, Silver Oaks Estates <br /> This Agreement for Final Map Approval Without Improvement Agreement or Bonds <br /> ("Agreement") is entered into June , 2015 between Kenneth R. Chrisman and Pamela L. <br /> Chrisman, Trustees of the Chrisman Family Trust ("Owners"), KC Bello LLC, a California <br /> limited liability corporation ("Developer") and the City of Pleasanton, a municipal corporation <br /> ("City"). <br /> RECITALS <br /> A. Owners are the owners of real property commonly known as 1944 Three Oaks Drive <br /> which has a City-approved vesting tentative map Tract 7660 (the "Property"); and <br /> B. Owners have an agreement with Developer to allow Developer to develop the City- <br /> approved planned unit development plan known as PUD-05, PUD-05-01M and PUD-05-07M, as <br /> amended(collectively"PUD-05") for that Property; and <br /> C. Owners and Developer seek City Council approval of the final map for Tract 7660, <br /> but Developer advises that Developer's bonding company is not able to provide bonds to insure <br /> the construction of the public and subdivision improvements shown in Tract 7660 until <br /> Developer is the record owner of Lots 1 — 10 and Parcels B, C, D-1, and D-2 of Tract 7660; and <br /> D. Pleasanton Municipal Code §§ 19.24.040 and 19.24.080 require that before the City <br /> Council considers approval of a final map, the person who owns the property must execute a <br /> subdivision improvement agreement and post bonds to guarantee the construction of the public <br /> improvements and subdivision improvements; and <br /> E. Developer intends to enter into such a subdivision improvement agreement and post <br /> the required bonds, but Owners and Developer first need the final map approved so that Owners <br /> can retain Parcel A as their existing residence, and convey to Developer Lots 1 — 10 and Parcels <br /> B, C, D-1, and D-2; and <br /> F. The City is willing to consider approval of the final map for Tract 7660 so long as <br /> Owners and Developer provide the City with reasonable assurances that any final map approval <br /> for Tract 7660 will be rescinded if adequate security to ensure the construction of the public and <br /> subdivision improvements for Tract 7660 is not received by the City. <br /> NOW, THEREFORE, in exchange for mutual consideration, the receipt of which is <br /> hereby acknowledged, the parties hereto agree as follows: <br /> 1. Bonding Company Commitment. Prior to the City Council's consideration of a final map <br /> for Tract 7660, Developer shall provide to the City Engineer, or his or her designee, a letter from <br /> Agreement for Final Map Approval without Improvement Agreement or Bonds—Tract 7660,Silver Oaks Estates Page I of 4 <br />
