Ok thank you for the clarification. When I read this letter, it seems to just say that you are open to reviewing a change
but not necessarily supportive, and that the HOA would review the project later. I don't believe anyone had ever
disputed that the HOA would be open to review changes, but thank you for clarifying that the intent is the HOA is giving
tentative approval of any changes and not just acceptance to review.
Jennifer Wallis, Associate Planner
THE CITY Of
pL£ASANTON.
Community Development Department
Planning Division
P.O. This resolution provides
tentative approval of such changes. The willingness of the board is there and has defined a broad outline of
what it would approve. It is also willing and open to any solution that addresses the neighbors' concerns.
Thx
Randy
From: Jennifer Wallis [mailto:jwallis@citvofoleasantonca.aov]
Sent: Monday, April 27, 2015 2:05 PM
To: Randy Ritter
Subject: RE: GEE Board resolution
Randy,
Can you please clarify whether this was at the request of the applicant or whether the applicant has submitted any plans
or provided any dialogue in which they have indicated to the HOA that they would like to do any of the of the listed
items within your letter? This letter only indicates that the HOA will allow them to submit a request for any of the
following items, which they have always had the right to do, and at which time you will then review the plans. The
language in the letter does not commit the HOA to approving anything and still allows for a reasonable amount of
discretion to the HOA to review, approve,or deny, any submittal at a later time. I am confused as to the purpose of the
letter since it does not commit to anything or clarify the HOA position since it is all subject to final review and approval
of plans to allow for changes "if necessary, and within reason?"
Jennifer
Jennifer Wallis, Associate Planner
2
