said additional parking shall be computed in accord- <br /> ance with Sec. 2-9.16, but shall not include that <br /> portion of the building which is exempt from parking <br /> requirements as indicated in this section. <br /> <br /> b. Any parcel of real property located wholly or par- <br /> tially within the boundaries of a parking assessment <br /> district referred to in subsection (a) , above, which <br /> is used for restaurant purposes shall be permitted <br /> to construct a building, the total square foot age <br /> of which will not exceed fifty-six percent (56%) of <br /> the buildable area of the lot without the need to <br /> provide additional parking. Any building in excess <br /> of the limitation herein imposed shall be subject <br /> to the same requirements for additional parking as <br /> set forth in subsection (a), above. <br /> <br /> c. Any building in existence at the time of the estab- <br /> lishment of the parking assessment district within <br /> which it is located, which exceeds the buildable <br /> area provisions set forth in subsection (a) , above, <br /> shall be deemed non-conforming and shall not be <br /> subject to additional parking requirements so long <br /> as the following factors do not change: <br /> <br /> 1. The building is not subject to use or uses <br /> different from those existing prior to the <br /> formation of the district. <br /> <br /> 2. No building permit is necessary to enlarge, <br /> alter, or modify the building or any portion <br /> thereof, unless required by law. <br /> <br /> 3. Less than fifty percent (50%) of the building <br /> is destroyed by fire, earthquake or any other <br /> calamity, Act of God, or by the public enemy <br /> and provided that restoration is started within <br /> one year and deligently pursued to completion <br /> <br /> Section 3. Section 2-9.21 (Existing Uses). Article <br />16, Chapter 2~ ~itle II of the Ordinance Code of the City of <br />Pleasanton is amended to read as follows: <br /> <br />~ 2-9.21 Existing Uses. No existing use of land or structure, <br />except one located W~'t'hin'a parking assessment district, shall be <br />deemed to be non-conforming solely because of the lack of off- <br />street parking facilities prescribed in this article, provided <br />that facilities being used for off-street parking on the <br />effective date of Ordinance No. 520, May 3, 1968, shall not be <br />reduced in capacity .to less than the number of spaces pre- <br />scribed in this article or reduced in area to less than the <br />minimum standards prescribed in this article. <br /> <br /> Section 4. This ordinanc~ shall become effective <br />thirty (3'0) days after its adoption. <br /> <br /> section 5. This ordinance shall be published once <br />within f~f'te~n (1'5) days after its adoption in the "THE TIMES," <br />a newspaper of general circulation, published in the City of <br />Pleasanton. <br /> <br /> -2- <br /> <br /> <br />
