THE CITY OF 16 <br /> =='1 --``-` CITY COUNCIL AGENDA REPORT <br /> pLEASANTONe <br /> May 5, 2015 <br /> Community Development <br /> Planning Division <br /> TITLE: P15-0010, CONSIDER AN APPEAL OF THE PLANNING COMMISSION'S <br /> APPROVAL FOR ADMINISTRATIVE DESIGN REVIEW (ADR) TO <br /> CONSTRUCT A 1,200-SQUARE-FOOT SECOND UNIT WITH AN <br /> APPROXIMATELY 317-SQUARE-FOOT ONE-CAR GARAGE <br /> APPLICANTS: John and Cynthia Rocha <br /> APPELLANT: Gary Hirata <br /> SUMMARY <br /> John and Cynthia Rocha submitted an ADR application to construct an approximately 1,200 <br /> square-foot detached second unit with an approximately 317-square-foot one-car garage <br /> located in the southwest corner of the property located at 547 Sycamore Road. <br /> On February 9, 2015, the Zoning Administrator approved the ADR, which was subsequently <br /> appealed to the Planning Commission by Kimberly Connors who resides at 414 Pioneer <br /> Trails Place. On March 25, 2015, Planning Commission denied the appeal, upholding the <br /> ADR approval, finding that the second unit complies with the City's Second Unit Ordinance, <br /> was designed to be consistent with North Sycamore Specific Plan (NSSP) and would not be <br /> detrimental to the public health, safety, or welfare, of the properties in the vicinity. <br /> Gary Hirata, property owner and neighbor adjacent to the subject site at 414 Pioneer Trails <br /> Place, subsequently filed an appeal of the approval, dated April 6, 2015, included in <br /> Attachment 2. <br /> PLANNING COMMISSION ACTION <br /> On March 25, 2015, the Planning Commission denied the appeal by Kimberly Connors and <br /> upheld the Zoning Administrator's approval (5-0 vote). <br /> RECOMMENDATION <br /> Staff believes that the proposed second unit is designed in accordance with the Pleasanton <br /> Municipal Code, and is appropriately situated on the site. Therefore, staff recommends that <br /> the City Council adopt the resolution (Attachment 1) denying the appeal and upholding the <br /> decision of the Planning Commission, subject to the Conditions of Approval in Exhibit A of <br /> Attachment 1, approved by the Planning Commission. <br /> FINANCIAL STATEMENT <br /> The proposed second unit would have a negligible financial impact on the City. Increases in <br /> property taxes would be used to provide services, such as police, fire, etc., for the increased <br /> demand generated by the second unit. <br />
