THE CITY OF 15 <br /> - "' CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONo <br /> May 5, 2015 <br /> Community Development <br /> Planning Division <br /> TITLE: P15-0008, CONSIDER AN APPEAL OF THE PLANNING <br /> COMMISSION'S APPROVAL OF A CONDITIONAL USE PERMIT AT <br /> 6602 OWENS DR., SUITE 100, TO OPERATE A VOCATIONAL <br /> TRAINING CENTER FOR ADULTS WITH DEVELOPMENTAL <br /> DISABILITIES <br /> APPLICANT: Social Vocational Services, Inc. <br /> APPELLANT: Wayne Rudick <br /> SUMMARY <br /> Social Vocational Services, Inc. requested a Conditional Use Permit (CUP) to operate a <br /> training center for adults with developmental disabilities in a tenant space (Suite 100) <br /> within an existing building located at 6602 Owens Drive. <br /> The Planning Commission approved the CUP, finding that the proposed location of the <br /> use is in accordance with the objectives of the Zoning Ordinance and the purpose of the <br /> district in which the site is located, and that it would not be detrimental to the public <br /> health, safety, or welfare, or materially injurious to the properties or improvements in the <br /> vicinity. <br /> Wayne Rudick, property owner and tenant of an adjacent suite at 6602 Owens Drive, <br /> subsequently filed an appeal of this approval. <br /> PLANNING COMMISSION ACTION <br /> On February 25, 2015, the Planning Commission unanimously approved (5-0 vote) the <br /> CUP for Social Vocational Services. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt the resolution (Attachment 1) denying the <br /> appeal and upholding the decision of the Planning Commission, subject to the <br /> Conditions of Approval in Exhibit A of Attachment 1, which include the conditions <br /> approved by the Planning Commission, plus two additional conditions to mitigate noise <br /> and safety concerns. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public services is anticipated. <br />
