BACKGROUND <br /> On May 1, 2012, the City Council approved the Planned Unit Development (PUD) <br /> Development Plan approving the construction of a mixed-use high-density <br /> residential/commercial development and a 0.55-acre public park at the property located <br /> at the northern corner of Gibraltar Drive and Hacienda Drive. The developer, Essex <br /> Properties, formerly BRE, will construct and dedicate the park property to the City and <br /> the City will be responsible for maintaining the park. <br /> At the time of Parks and Recreation Commission review and City Council approval, it <br /> was not known that proposed project buildings would be developed over private utilities <br /> that service two adjacent sites, the Shaklee and Kaiser properties. Given this <br /> information, the new residential development and park land layout were modified in <br /> order to limit the impacts of the private utility lines that service adjacent properties <br /> (please see Image 1 on page 3, or Attachment 3). Essex applied for and received <br /> approval for a new site and park layout design through a PUD Minor Modification <br /> application in March of 2014. Staff and the applicant have worked closely over the last <br /> year to design a public park with appropriate amenities that will have little to no impact <br /> on the private utility lines and believe that the revised proposal matches the quality of <br /> the previously approved park. Please refer to the March 12, 2015 Parks and Recreation <br /> staff report in Attachment 4 for additional background information. <br /> This park is located in the upcoming Recycled Water Distribution System Project area. <br /> It is being designed to use recycled water for all irrigation. <br /> PARKS AND RECREATION COMMISSION <br /> The Parks and Recreation Commission held a public hearing on March 12, 2015, to <br /> review the final park design. Detailed information on this meeting is provided by the <br /> attached draft excerpt of the Parks and Recreation Commission minutes (Attachment <br /> 5). No members of the public spoke at the hearing. The Commission recommended <br /> approval of the redesigned park on a 4-0 vote. <br /> DISCUSSION <br /> Previously Approved Park Layout and Amenities <br /> The previously approved 0.55-acre public park was proposed at the southwest side of <br /> the project site, on the north side of Gibraltar Drive, and had a flag-shaped layout (see <br /> Image 1, on page 3, or Attachment 3). The park was approved by the City Council in <br /> 2012 with an approximately 5,566 square-foot multipurpose grass area for sports <br /> activities and seasonal events, two separate play apparatus areas (one for ages <br /> 3-5 years and one for ages 5-12 years), shade sails, seating areas, trellises, barbeques, <br /> bike racks, and an open grass area (see Image 2 on page 3, or Attachment 3). <br /> Page 2 of 6 <br />
