ORDINANCE NO. 838 <br />Page 2. ~- <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />ORDAIN, ON AN URGENCY BASIS, AS FOLLOWS: <br /> <br />Section 1. The structures listed in Exhibit "A" are placed into the <br /> Historical Landmark Overlay District for a period of four (4) <br /> months, unless extended, or unless permanent H-O zoning is <br /> affixed thereto, whichever occurs first in time. <br /> <br />Section 2. This ordinance is declared to be adopted pursuant to <br /> Section 65858 of the Government Code of the State of Cali- <br /> fornia and is necessary and required to protect the public <br /> safety, health and welfare of the citzens of the City of <br /> Pleasanton for the reason stated above. <br /> <br />Section 3. All uses which are in conflict with the H-O (Historical <br /> Landmark Overly) District of the Ordinance Code of the City <br /> of Pleasanton, are hereby prohibited on the above described <br /> structures except that the underlaying zoning of the struc- <br /> tures is not affected by this ordinance. <br /> <br />Section 4. The City Council directs the Historical Landmark Advisory <br /> Committee and the City Staff to undertake and conduct the <br /> necessary studies required and to report back to the City <br /> Council as soon as feasible. <br /> <br />Section 5. This ordinance shall be of force and effect immediately <br /> upon its passage and adoption and shall be of no further force _. <br /> and effect four (4) months from the date of its adoption <br /> thereof unless extended as provided by law, or unless, prior <br /> to expiration, the structures in Exhibit "A" are permanently <br /> placed in the H-O District· <br /> <br />Section 6. If any section,subsection, subdivision, paragraph, sentence, <br /> clause or phrase of this ordinance or any part thereof is, for <br /> any reason, held to be unconstitutional, such decision shall <br /> not effect the viability of the remaining portion of this <br /> ordinance or any part thereof. The City Council hereby de- <br /> clares that it would have passed each section, subsection, sub- <br /> division, paragraph, sentence, clause or phrase thereof irres- <br /> pective of the fact that any one or more sections, subsections, <br /> subdivisions, paragraphs, sentences, clauses or phrases be de- <br /> clared unconstitutional. <br /> <br />Section 7. This Ordinance shall be published once within fifteen (15) <br /> days after its adoption in "THE TIMES," a newspaper of general <br /> circulation, published and circulated in the City of Pleasanton. <br /> <br />INTRODUCED AND ADOPTED AS AN URGENCY ORDIN~ ~CE at a regular meeting of <br />the City Council on November 29, 197.7.
