ORDINANCE NO. 838 Page 2. ~- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN, ON AN URGENCY BASIS, AS FOLLOWS: Section 1. The structures listed in Exhibit "A" are placed into the Historical Landmark Overlay District for a period of four (4) months, unless extended, or unless permanent H-O zoning is affixed thereto, whichever occurs first in time. Section 2. This ordinance is declared to be adopted pursuant to Section 65858 of the Government Code of the State of Cali- fornia and is necessary and required to protect the public safety, health and welfare of the citzens of the City of Pleasanton for the reason stated above. Section 3. All uses which are in conflict with the H-O (Historical Landmark Overly) District of the Ordinance Code of the City of Pleasanton, are hereby prohibited on the above described structures except that the underlaying zoning of the struc- tures is not affected by this ordinance. Section 4. The City Council directs the Historical Landmark Advisory Committee and the City Staff to undertake and conduct the necessary studies required and to report back to the City Council as soon as feasible. Section 5. This ordinance shall be of force and effect immediately upon its passage and adoption and shall be of no further force _. and effect four (4) months from the date of its adoption thereof unless extended as provided by law, or unless, prior to expiration, the structures in Exhibit "A" are permanently placed in the H-O District· Section 6. If any section,subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part thereof is, for any reason, held to be unconstitutional, such decision shall not effect the viability of the remaining portion of this ordinance or any part thereof. The City Council hereby de- clares that it would have passed each section, subsection, sub- division, paragraph, sentence, clause or phrase thereof irres- pective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be de- clared unconstitutional. Section 7. This Ordinance shall be published once within fifteen (15) days after its adoption in "THE TIMES," a newspaper of general circulation, published and circulated in the City of Pleasanton.
