CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 838 <br /> <br /> AN INTERIM ORDINANCE PLACING CERTAIN STRUCTURES <br /> INTO A'H-O (HISTORICAL LANDMARK OVERLAY) DISTRICT <br /> FOR FOUR MONTHS AND ADOPTING THE SAME AS AN URGENCY <br /> MEASURE <br /> <br /> WHEREAS, Section 65858 of the Government Code of the State of <br />California, permits the City Council, in order to protect the pub- <br />lic safety, health and welfare, to adopt as an urgency measure an <br />interim ordinance prohibiting any uses which may be in conflict <br />with a contemplated zoning proposal which the City Council, Plan- <br />ning Commission or Planning Department is considering or studying or <br />intending to study within a reasonable time; and <br /> <br /> WHEREAS, the City Council, at its meeting of September 20, 1977, <br />adopted Resolution No. 77-255 designating the City Council as the <br />Historical Landmark Advisory Committee on an interim basis and adopted <br />Resolution No. 77-256 designating certain structures as historic <br />structures in accordance with the City's Historical Overlay District <br />ordinance; and <br /> <br /> WHEREAS, Counci~ at itsmeetings of October 25, 1972 and November 8, 1977, <br />adopted Resolutions No. 77-284 and No. 77-303 appointing certain citizens <br />to the Historical Landmark Advisory Committee; and <br /> <br /> WHEREAS, said committee, at its meeting of November 28, 1977, re- <br />viewed the structures designated by the City Council and made addi- <br />tional recommendations; and <br /> <br /> WHEREAS, the committee will be undertaking a study of revisions <br />to the Historical Landmark Overlay (H-O) District; and <br /> <br /> WHEREAS, the structures listed in Exhibit "A'~, attached hereto <br />and incorporated herein by reference, are capable of being permanently <br />placed into the H-O District; and <br /> <br /> WHEREAS, if the structures listed in Exhibit "A" were modified, <br />altered, relocated or demolished prior to the finalization of revis- <br />ions to the H-O ordinance, the historic heritage of Pleasanton and its <br />citizens would be adversely effected; and <br /> <br /> WHEREAS, the public health, safety and welfare require the place- <br />ment of the structures listed in Exhibit "A" into the H-O District <br />pending the completion of the study mentioned above. <br /> <br /> WHEREAS, the owners of said structures will not be unduly incon- <br />venienced by passage of this ordinance as an urgency measure since it <br />will last for only four months, any extension thereof must comply with <br />the hearing requirements of the State Zoning Act (Sec. 65850 et seq. <br />of the Government'Code), and any or all of the affected structures can <br />be removed from the H-O District at any time that the necessary stud- <br />ies are completed. <br /> <br /> <br />
