District) and to levy and coiled assessments within the TVTMD boundaries pursuant to <br /> the Property and Business Improvement District Law of 1994, California Streets and <br /> Highways Code Section 36600 et seq. The boundaries of the TVTMD shall be the cities <br /> of Pleasanton, Livermore, Dublin, the town of Danville, and those portions of the <br /> unincorporated areas of Contra Costa and Alameda Counties as illustrated on the <br /> attached map (Exhibit A). The TVTMD shall include all lodging businesses located within <br /> these boundaries. <br /> Section 5. The name of the district shall be changed from Tri-Valley Tourism <br /> Business Improvement District to Tri-Valley Tourism Marketing District. <br /> Section 6. Visit Tri-Valley proposes to administer marketing programs to <br /> promote the assessed lodging businesses in the Tri-Valley area as a tourism destination <br /> and to fund projects, programs, and activities that provide a specific benefit to lodging <br /> businesses within the boundaries of the District. <br /> Section 7. The annual assessment rate is $2.00 per paid occupied room per <br /> night. Based on the benefit received, assessments will not be collected on stays of more <br /> than thirty (30) consecutive days, nor on stays by any Federal or State of California <br /> officer or employee when on official business who makes a claim that they are exempt, <br /> nor on stays by any officer or employee of a foreign government who is exempt by <br /> reason of express provision of federal law or international treaty. The annual <br /> assessment rate may be subject to an increase each year starting in the third year, the <br /> amount of which shall be determined by the VTV Board. The annual assessment rate <br /> shall not exceed $3.00 per paid occupied room per night. <br /> Section 8. Each city, town and county shall be responsible for collecting the <br /> assessments from the lodging businesses within their respective jurisdiction. All lodging <br /> businesses available to the public, including new lodging businesses which open during <br /> the term of the district, shall be subject to the assessment. Assessments pursuant to the <br /> TVTMD shall not be included in gross room rental revenue for purposes of determining <br /> the amount of transient occupancy tax. <br /> Section 9. The TVTMD will have a seven-year term beginning July 1, 2015 <br /> through June 30, 2022. <br /> Section 10. It is estimated that the total annual assessments will be <br /> $1,822,000 in the initial year. This amount is expected to fluctuate as room sales do. <br /> The assessments levied for the TVTMD shall be applied towards marketing and <br /> promotions to increase tourism and market the assessed Tri-Valley area lodging <br /> businesses as tourist, meeting, and event destinations. Funds remaining at the end of <br /> any year may be used in subsequent years in which TVTMD assessments are levied as <br /> long as they are used consistent with the requirements of this Resolution, the <br /> Management District Plan, and the Resolution of Renewal. If the term of the TVTBID is <br /> not extended beyond seven years (or if the term of the TVTBID is less than seven years) <br /> and there are funds remaining at the end of the term, such funds may be used for <br /> purposes consistent with the requirements of this Resolution and the Management <br /> District Plan. <br />
