Section 3. The City Council finds that the Management District Plan <br /> satisfies all requirements of Streets and Highway Code sections 36622. <br /> Section 4. The City Council declares its intention to renew the Tri- <br /> Valley Tourism Marketing District (previously the Tri-Valley Tourism Business <br /> Improvement District) and to levy and collect assessments within the TVTMD <br /> boundaries pursuant to the Property and Business Improvement District Law of <br /> 1994, California Streets and Highways Code Section 36600 et seq. The <br /> boundaries of the TVTMD shall be the cities of Pleasanton, Livermore, Dublin, <br /> the town of Danville, and those portions of the unincorporated areas of Contra <br /> Costa and Alameda Counties as illustrated on the attached map (Exhibit A). The <br /> TVTMD shall include all lodging businesses located within these boundaries. <br /> Section 5. The name of the district shall be changed from Tri-Valley <br /> Tourism Business Improvement District to Tri-Valley Tourism Marketing District. <br /> Section 6. Visit Tri-Valley proposes to administer marketing programs <br /> to promote the assessed lodging businesses in the Tri-Valley area as a tourism <br /> destinations and to fund projects, programs, and activities that provide a specific <br /> benefit to lodging businesses within the boundaries of the District. <br /> Section 7. The annual assessment rate is $2.00 per paid occupied <br /> room per night. Based on the benefit received, assessments will not be collected <br /> on stays of more than thirty (30) consecutive days, nor on stays by any Federal <br /> or State of California officer or employee when on official business who makes a <br /> claim that they are exempt, nor on stays by any officer or employee of a foreign <br /> government who is exempt by reason of express provision of federal law or <br /> international treaty. The annual assessment rate may be subject to an increase <br /> each year starting in the third year, the amount of which shall be determined by <br /> the VTV Board. The annual assessment rate shall not exceed $3.00 per paid <br /> occupied room per night. <br /> Section 8. Each city, town and county shall be responsible for collecting <br /> the assessments from the lodging businesses within their respective jurisdiction. <br /> All lodging businesses available to the public, including new lodging businesses <br /> which open during the term of the district, shall be subject to the assessment. <br /> Assessments pursuant to the TVTMD shall not be included in gross room rental <br /> revenue for purposes of determining the amount of transient occupancy tax. <br /> Section 9. The TVTMD will have a seven-year term beginning July 1, <br /> 2015 through June 30, 2022. <br /> Section 10. It is estimated that the total annual assessments will be <br /> $1,822,000 in the initial year. This amount is expected to fluctuate as room sales <br /> do. The assessments levied for the TVTMD shall be applied towards marketing <br /> and promotions to increase tourism and market the assessed Tri-Valley area <br />
