He said he would like to look seriously at the idea of accelerating the <br /> project's timeline when the CIP comes forward because of the tremendous asset this is to the city. <br /> MOTION: It was m/s by Cook-Kallio/Pentin to approve the staff recommendation, with additional <br /> direction regarding the cistern as noted. Public Hearing: PUD-102/P14-0014, MD Roesbery, Inc. — Consider introduction of ordinances <br /> to rezone 0.776-acres for a Valero service station at 3192 Santa Rita Road from C-N <br /> (Neighborhood Commercial) to the PUD-C (Planned Unit Development - Commercial), and a <br /> PUD Development Plan to convert 1,752 sq. ft. of the existing 2,634 sq. ft. auto service building <br /> to a convenience store and the remaining floor area to a drive-through carwash; and approval of <br /> a Conditional Use Permit to operate a convenience store with the sale of alcoholic beverages <br /> and a drive-through carwash in the existing service station <br /> Planning Manager Weinstein presented the staff report, stating that the applicant is requesting to <br /> rezone the property located at 3192 Santa Rita Road to a PUD-C district and adopt a PUD <br /> Development Plan to allow for the development and operation of a 7-Eleven convenience store with <br /> alcohol sales, in conjunction with a carwash and existing gas station. He reviewed the 0.776-acre site, <br /> located at the southeast quadrant of Santa Rita Road and West Las Positas and surrounded by <br /> commercial uses to the east and south, Fire Station No. 3 the north and residential development across <br /> Santa Rita Road to the west. Beyond the immediate commercial area are residential uses to the east <br /> and northeast as well as Fairlands Elementary School. <br /> Mr. Weinstein provided the project background, stating that the existing Valero gas station and <br /> automotive service facility were constructed in approximately 1989 with the site operating as a gas <br /> station for over 40 years. The applicant desires to close the existing automotive service building and <br /> construct a convenience market with drive-through carwash, while retaining the existing gas station. <br /> The site's current C-N zoning does not allow a gas station with convenience market or drive-through <br /> carwash. Furthermore, non PUD districts which do allow a gas station with convenience store do not <br /> allow the sale of alcoholic beverages. The applicant is therefore requesting rezoning to a PUD-C district <br /> and Conditional Use Permit for a drive-through carwash and convenience store with alcohol sales. The <br /> applicant's initial request for 24-hour convenience store operations was ultimately modified to limit store <br /> hours to between 5 A.M. and 1 A.M. following an initial review and workshop by the Planning <br /> Commission. <br /> The uses allowed within the PUD-C district are those that permitted and conditionally permitted in the <br /> C-N district, with the additions of a convenience market with or without the sale of alcoholic beverages. <br /> Drive-through carwashes are conditionally permitted uses in conjunction with a gas station. The <br /> proposed PUD Development Plan would involve the reconstruction of the existing automotive service <br /> building into a convenience market, the drive-through carwash and other physical changes to the site. <br /> City Council Minutes Page 10 of 22 November 18, 2014 <br />
