THE CITY OF <br />®i w : a <br />pLEASANTONC <br />CITY COUNCIL AGENDA REPORT <br />10 <br />December 2, 2014 <br />Community Development Department <br />TITLE: CONSIDER GENERAL PLAN AMENDMENTS, REZONING, <br />ESTABLISHMENT OF A ZONING DESIGNATION, A PLANNED UNIT <br />DEVELOPMENT (PUD) DEVELOPMENT PLAN, AND A PUD MAJOR <br />MODIFICATION TO ACCOMMODATE A PROPOSED CHICK -FIL -A <br />RESTAURANT TO BE LOCATED AT 6111 JOHNSON COURT, A <br />VACANT PARCEL, AND 5225 -6015 JOHNSON DRIVE <br />SUMMARY <br />The proposed applications would amend General Plan Land Use Designations, rezone <br />and establish a new zoning designation, establish a Planned Unit Development (PUD) <br />development plan, and modify an approved Planned Unit Development to allow the <br />development and operation of a Chick -fil -A restaurant and related on- and off -site <br />improvements. The Planning Commission recommended approval of the applications <br />on a 4 -0 vote (Commissioner Balch recused himself due to an economic conflict). <br />PLANNING COMMISSION RECOMMENDATION <br />Recommended approval of the applications subject to the Conditions of Approval as <br />proposed by staff with additional conditions to enhance the building's north and east <br />elevations and enhance the proposed landscaping. <br />RECOMMENDATION <br />1. Find that the proposed project would not have a significant effect on the environment <br />and adopt a resolution approving the attached draft Negative Declaration <br />(Attachment 4); <br />2. Find that the General Plan Land Use Amendments are consistent with the Goals and <br />Policies of the General Plan; <br />3. Find that the proposed PUD zoning /rezoning and Development Plan and PUD Major <br />Modification are consistent with the General Plan and the purposes of the PUD <br />Ordinance; <br />4. Make the PUD findings for the proposed development plan as stated in the October <br />22, 2014 Planning Commission staff report (pages 23 through 25); <br />5. Adopt a resolution approving Case P13 -2533, General Plan Amendments to change <br />the land use designations for the proposed development (Attachment 3); <br />6. Introduce a draft ordinance approving Case PUD -100 for the construction of a Chick - <br />fil-A restaurant with double drive - through lanes and site improvements subject to the <br />
