However, in recognition of the sports group's contribution to Bernal Park, Phase 11, <br />the MOU states that the City would not assess any user fees on the participating sports <br />groups for the full ten year period. User fees could be assessed on non - participating <br />groups or other City park functions. <br />Based on the above contribution process, the City will utilize its financial resources to <br />fully fund the park with the understanding that it will be reimbursed over time from <br />monies raised through the fund raising campaign and the "gap" payments collected over <br />a period of ten years. <br />Building on practices established as part of the Firehouse Arts Center fundraising effort, <br />an important component of this fundraising campaign will be the availability of naming <br />recognition in return for a specific amount of donation. To determine the appropriate <br />amount of donation required to qualify for naming recognition, the City utilized the <br />services of a local consultant that specializes in valuing fundraising items and based on <br />that analysis, staff and the sports groups made adjustments so that the naming <br />recognition proceeds could meet the fundraising target. The items eligible for naming <br />recognition and the related expected contribution is detailed on Attachment 2. As <br />indicated, these items include field naming, facility naming, benches, tables etc. In <br />addition to those items on the attached sheet, the project will also include a donor <br />recognition wall that includes the inscribed names of individuals who made donations to <br />the project. <br />Related to naming recognition, most items, except for facility naming, have a term limit of <br />ten years which generally equates to the anticipated life of the item. As such, when the <br />City replaces an item that includes naming recognition, it can elect to replace it without <br />the naming recognition or engage in additional donations for the new item. This process <br />is necessary to assure that the City isn't continually, reaffixing naming plaques as part of <br />its ongoing equipment replacement program. The facility naming rights has a period of <br />five to ten years which is generally consistent with naming standards used in other <br />facilities and municipalities. <br />Finally, the MOU is clear that naming rights do not confer on any person any direct or <br />implied control, authority or preference concerning Bernal Park, Phase II programming, <br />use or policy and that these matters reside solely with the City. Further, all facility <br />programming will be consistent with the City's Field Allocation Policy and participating <br />sports groups will be subject to the policy regardless of the amount of funds raised or <br />involvement with the program. <br />Gift Acknowledgement Policy and Procedure <br />As part of the overall fundraising program, staff has established policy and procedure <br />(Attachment 3) to address the receipt of funds and the recognition of pledges. In general, <br />these policies cover the types of donations allowed and the City's role in that process <br />which generally consists of maintaining a donor database, affixing naming recognition to <br />the appropriate item and /or piece of equipment, and issuing an acknowledgement letter, <br />with the City's tax identification number, which would be used for tax deduction <br />Page 4 of 6 <br />
