r_r■f_tIMMUS3 <br />BERNAL COMMUNITY PARK, PHASE II <br />GIFT ACKNOWLEDGMENT POLICY AND PROCEDURE <br />GENERAL TERMS <br />The City of Pleasanton accepts outright gifts and future gift commitments that are consistent with <br />the Bernal Community Park, Phase II Memorandum of Understanding (MOU). Donations <br />generally will be accepted from individuals, partnerships, corporations, organizations, <br />government agencies or other entities, including anonymous sources unless acceptance of gifts is <br />inconsistent with the City's public purpose. <br />The City will maintain a donor database that includes the name of the donor (e.g., individual, <br />corporation, foundation, organization, etc.), the amount of the donation, the information to be <br />included on any naming recognition plaque or signage, the start and end date of any donor <br />naming recognition, terms for major sponsorship facility naming recognition, and if available, <br />the donor's contact information. <br />Multiyear pledges for major sponsorships over $10,000 are permissible for no more than three <br />years, except in the case of naming rights memorialized through an agreement with the City. Any <br />multi -year donation requires the donor to complete a Pledge Agreement detailing the purpose of <br />the gift, payment schedule and designation of naming recognition. <br />A gift -in -kind donation is an item such as equipment, services, software or a product that a donor <br />voluntarily transfers to the City as part of the fundraising campaign. Acceptance of a gift -in -kind <br />donation is subject to the pre - approval of the City Manager who has the sole discretion to accept <br />or reject a gift-in -kind offering. Any approved gift -in -kind requires a Pledge Agreement <br />indicating support of the City's public purpose and proper acknowledgement. If accepted, the <br />donated item(s) becomes the property of the City, which retains the right to dispose of a gift -in- <br />kind as it sees fit, unless another arrangement has been made with the donor as memorialized <br />through a contractual agreement. <br />The City is solely responsible for determining the placement, style and type of naming <br />recognition and the City Manager may elect at his discretion to reject any donation and to <br />determine the terms of facility naming rights and or the content of any naming recognition. <br />To the extent allowed by the California Public Records Act, donor information will remain <br />private and confidential and will not be made public. Information required to be disclosed <br />includes: (i) the amount and date of a donation; (ii) any donor - designated use or purpose of a <br />donation; and (iii) any other donor - imposed restrictions on the use of a donation. Information to <br />be maintained as confidential includes: personal financial information and gift planning <br />information of a donor or prospective donor. <br />CITY ACKNOWLEDGEMENT AND PROCESSING <br />1. The City will acknowledge all donations and gifts -in -kind within seven business days after <br />receipt of donations using appropriate thank you letters based on the gift level. <br />
