BACKGROUND
On March 3, 2009, the City Council approved a residential development with 110 single -
family homes known as the Ironwood Active Adult Community or Village at Ironwood.
As a condition of approval, the developer, Ponderosa Homes was required to construct
a public trail adjacent to the development on property located between the southem
boundary of Lake I and the northern boundary of the Village at Ironwood. Portions of
the public trail are located within the Mohr Avenue right of way owned by the City.
Other portions of the public trail are located on property owned by Zone 7, thus, the City
needs a License Agreement from Zone 7 to place the trail on Zone 7 property in
exchange for the City agreeing to maintain the trail. Last July, the Council approved a
First Amendment to the License Agreement to include this public trail. Since that time,
City staff has received requests from a few property owners within the Village at
Ironwood to move the trail north and farther away from their properties. This Second
Amendment to the License Agreement accomplishes this by moving portions of the trail
north and closer to Lake I.
Also in July of 2013, the Council approved a License Agreement related to the storm
drain system discussed above. Zone 7 never executed that agreement and staff from
the City and Zone 7 have worked together to prepare a new agreement (Maintenance
Agreement) that will set forth the obligations of both parties with regard to maintenance.
The City will be responsible for routine preventative maintenance of the system while
Zone 7 will be responsible for minor and major repairs.
DISCUSSION
Ponderosa Homes has completed grading work for the trail and will complete the
remaining work including fencing, gates, landscaping etc. before final acceptance of the
subdivisions within "The Village at Ironwood." The trail will be open to the public to
enter at Mohr Avenue on the west end, but the trail will "dead end" at the east end of the
Village at Ironwood. Unlike the general public access, Ironwood residents will also be
able to ingress /egress to the trail at the east end through a locked gate the north end of
Chatham Place. When the East Pleasanton Specific Plan is developed the trail will be
extended further east and open to the public. The Second Amendment to License
Agreement allows the trail to be constructed on Zone 7 property. The Maintenance
Agreement sets forth the respective obligations of Zone 7 and the City with regard to the
storm drain system installed as part of Ponderosa Homes' project.
This item was originally included on the September 2, 2014 City Council meeting
agenda, but continued at the request of city staff. Just prior to the September Council
meeting, staff attended the Ironwood Homeowners Association meeting and teamed
that Ironwood residents were very concemed about trees being planted along the trail
blocking their views of Mount Diablo. The requirement that trees be planted in the trail
area came from Zone 7 staff due to a large number of Black Walnut trees that were
removed as a result of grading necessary for the Ironwood project. Zone 7 has now
removed the requirement that the trees be planted along the trail, but instead wants
trees planted in the buffer area along Martin Avenue. Ponderosa has agreed to plant
the trees in this location.
