THE CITY OF <br />pL£ASANTONC <br />CITY COUNCIL AGENDA REPORT <br />8 <br />December 2, 2014 <br />Community Development <br />Engineering Division <br />TITLE: APPROVE SECOND AMENDMENT TO THE LICENSE AGREEMENT WITH <br />ZONE 7 OF ALAMEDA COUNTY FLOOD CONTROL AND WATER <br />CONSERVATION DISTRICT (ZONE 7) TO MODIFY THE LOCATION OF A <br />PUBLIC TRAIL ALONG THE SOUTH SIDE OF LAKE I; AND APPROVE A <br />MAINTENANCE AGREEMENT WITH ZONE 7 REGARDING A STORM <br />DRAIN SYSTEM LOCATED NEAR THE PUBLIC TRAIL <br />SUMMARY <br />On August 27, 2008, the City and Zone 7 entered into a License Agreement in which <br />Zone 7 agreed to allow the City to construct and maintain a trail and park -like <br />atmosphere on property owned by Zone 7 adjacent to Martin Avenue. On July 16, <br />2013, the City Council approved a First amendment to the License Agreement which <br />allowed a public trail to be installed on Zone 7 property between Lake I and the Village <br />at Ironwood development along the Mohr Avenue right of way. By approving a Second <br />amendment to this License Agreement, the City will be able to move portions of the <br />planned trail slightly north and farther away from the residents in the Village at Ironwood <br />(as shown on Attachment 1). <br />As part of the Village at Ironwood project, Ponderosa Homes installed a storm drain <br />system which collects and conveys storm water from Zone 7's property to the public <br />storm drain system. Zone 7 and the City seek to enter into a Maintenance Agreement <br />which sets forth each party's obligations with regard to that storm drain system. <br />RECOMMENDATION <br />1. Authorize the City Manager to execute the Second Amendment to License <br />Agreement with Zone 7. <br />2. Authorize the City Manager to execute a Maintenance Agreement for the storm drain <br />system. <br />FINANCIAL STATEMENT <br />There will be a minor increase in the City operating costs in order to maintain the trail <br />and to provide routine preventative maintenance to the storm drain system. <br />
