ROLL CALL VOTE: <br /> AYES: Commissioners Balch, Piper and Ritter <br /> NOES: Commissioners Allen and O'Connor <br /> ABSTAIN: None <br /> RECUSED: None <br /> ABSENT: None <br /> Chair O'Connor stated that the only reason he is opposed is that he does not like the <br /> idea of the community having to come back and raise that issue for the Commission. <br /> He indicated that he wished the Commission could find it the other way, but he really <br /> believes this is going to be a good project for this corner. He added that he knows that <br /> with the investment the people are putting in, and since they own both the real estate <br /> and the business, the applicant is really going to make this work. <br /> Resolution No. PC-2014-41 recommending approval of the Negative Declaration, <br /> Resolution No. PC-2014-42 recommending approval of Case PUD-102, the PUD <br /> Rezoning and Development Plan, and Resolution No. PC-2014-43 recommending <br /> approval of Case P14-0014, the Conditional Use Permit, were entered and adopted at <br /> motioned. <br /> Chair O'Connor called for a break at 10:08 p.m. and thereafter, reconvened the regular <br /> meeting at 10:20 p.m. <br /> b. PUD-106, John Gutknecht for Habitec Architecture <br /> Application for PUD Development Plan for the construction of an <br /> automobile dealership consisting of an approximately 31,792-square-foot <br /> building with a 2,175-square-foot service canopy and 1,250-square-foot car <br /> wash, and related site improvements on the Auto Mall site at Staples <br /> Ranch. Zoning for the property is PUD-C (Planned Unit Development— <br /> Commercial) District. <br /> Shweta Bonn presented the staff report and described the scope, layout, and key <br /> elements of the proposal. <br /> Chair O'Connor noted that on page 9 of the staff report, it states that a maximum <br /> lighting level of 12.9 footcandles is being proposed in the customer, employee, and <br /> service area where 10 footcandles is allowed. He inquired if this is a transition between <br /> the 30-footcandle area and the 10-footcandle area. <br /> Ms. Bonn replied that the 12.9-footcandle area occurs where the customer service and <br /> employee area transitions into the sales and display area. She noted that because it is <br /> right at the border between the two areas and it is difficult to draw an exact boundary, <br /> staff deemed it appropriate and acceptable to have a higher level at that location. <br /> PLANNING COMMISSION MINUTES, August 27, 2014 Page 34 of 44 <br />
